OAKLAND, CALIFORNIA (BNO NEWS) – A Walnut Creek, California woman was sentenced to five years in prison and to pay $123,740 in restitution for forced labor of her domestic servant, prosecutors announced on Thursday.

Mabelle de la Rosa Dann, 46, a Peruvian native, was found guilty during trial of forced labor, unlawful use of documents in furtherance of forced labor, harboring an illegal alien for private financial gain, conspiracy to commit visa fraud and visa fraud.

Dann and at least another person fraudulently obtained a visa for a Peruvian woman. They also smuggled the woman into the United States in July 2006. For 21 months, Dann forced the victim to cook, clean, and provide childcare in a small, one-bedroom apartment.

The defendant promised the domestic worker payment for her labor but instead she confiscated the passport and identification of the Peruvian alien. Dann subjected the victim to humiliating and degrading conduct that led the victim to believe that she would be falsely accused of theft if she fled.

Dann never paid the victim for her work. Despite not knowing any resident in the U.S. or not speaking English, the domestic servant managed to escape with the help of local residents and parents at a local elementary school.
