Queens, NY man indicted for stealing leads to rape charges, including an 11-year-old

PHOENIX, ARIZONA (BNO NEWS) – A man from Queens, New York was convicted of petit larceny, but after his DNA sample was examined, he was indicted for two rape cases, prosecutors said on Thursday.

Mauricio Rosales, 32, of Woodhaven, Queens pleaded guilty to petit larceny last November for stealing in excess of $3,000 from a former employer, when he was required by law to submit a DNA sample to the state database.

The DNA sample was positively matched through the state data bank, which is known as CODIS (the combined DNA Index System) to evidence collected at two previous rape crime incidents.

On October 20, 2000, Rosales allegedly entered an 11-year-old girl’s bedroom in Woodhaven through a back door, raping her while her family was sleeping upstairs. Before fleeing, he stole several items from the residence and threatened to kill the child if she told anyone of the incidents. After he left, she ran and informed her mother of the happenings.

Rosales is accused of another incident on July 17, 2003, when he allegedly approached a 19-year-old woman while she was sitting in front of her home, then pulling her at knifepoint into her driveway where he allegedly raped and robbed her.

Rosales is now facing up to 50 years in prison if charged with two counts of first-degree rape, one count of first-degree burglary, one count of first-degree robbery, one count of first-degree sexual abuse and one count of first-degree attempted robbery.

“This case underscores the crucial importance of DNA evidence which is irrefutable proof of guilt or innocence,” District Attorney Brown said. “It is time for the Legislature to once again expand the DNA law to authorize collection of samples from all convicted defendants – not just the approximately 50 percent of convicted defendants who now are required to submit DNA samples.”

The investigation was conducted by Detectives Richard Santangelo, James Ropenus and Steve Aquaviva of the New York City Police Department’s Queens Special Victims Squad under the supervision of Lieutenant Arthur Hall, Commanding Officer.
