Federal district court rules California gay marriage ban unconstitutional
August 5th, 2010 - 4:04 am ICT by BNO NewsSAN FRANCISCO (BNO NEWS) — A U.S. District Court Judge in San Francisco on Wednesday ruled that California’s gay marriage ban is unconstitutional.
Chief U.S. District Judge Vaughn Walker released his written decision on the voter-approved ban, better known as Proposition 8, saying that it violates the Constitution’s 14th Amendment on equal protection.
The ruling is a key victory to gay rights advocates in what seems almost certain to eventually reach the U.S. Supreme Court. Lawyers on both sides of the case have said they would certainly appeal the decision if the judge did not rule in favor of them.
Christine Quinn, the Council Speaker of the Council of New York City, immediately welcomed the decision. “Today’s decision by the California District Court marks a historic day in the fight for LGBT equality,” she said.
