Elizabeth Smart’s Suspected Kidnapper To Face Trial

suspectSalt Lake City, March 2, (THAINDIAN NEWS) The case of Elizabeth Smart’s Kidnapping eight years ago allegedly by Brian David Mitchell will be ultimately heard in the court later this year, according to reports. The case has been languishing for a long time as the suspect was found mentally unstable and incapable of appearing at the court. On Monday, the U.S. District Judge Dale Kimball has reportedly written in his 149 page ruling that the suspect Brian David Mitchell has enough capability to go through a trial in the court room.

Dale Kimball’s report follows the 10 days hearing in 2009 that discussed Brian David Mitchell’s capability to stand a trial at the court. Dale Kimball in his report has said that there are enough proofs that point to the fact that the suspect can bear the trial proceedings. In October last year, Brian David Mitchell has reportedly started singing several times in court room. He was reportedly taken out of court due to this behavior. On Monday, Dale Kimball dismissed the suspect’s court room behavior as a “contrivance” that Brian David Mitchell had used to prove his case of mental illness. The lawyer of Brian David Mitchell, Robert Steele however has reportedly exclaimed that his client is mentally ill. He has added that he will be preparing of the trial to follow and will enter the court room with a mentally ill client.

Elizabeth Smart’s father Ed Smart has proclaimed his gratitude in front of the media for the District judge’s ruling. Though he said that he is not sure whether his daughter knows of the latest development or not but said that the decision comes as a good news to all crime victims reportedly.
