Elizabeth Smart’s suspect - Brian David Mitchell deemed ‘competent’

Salt Lake City, Mar 2 (THAINDIAN NEWS) The main suspect in the Elizabeth Smart kidnapping case – Brian David Mitchell, has been deemed competent enough to stand trial. A federal judge said on Monday that Brian Mitchell was not mentally unstable, and he was just faking mental instability, so that he could escape the trial for his heinous crimes.
“The evidence proves that Mitchell has the capacity to assist his counsel in his defense and the ability to behave appropriately in the courtroom,” the U.S. District Judge Dale Kimball said in his landmark 149-page ruling. There was a big hue and cry over the issue whether he is competent enough to stand trial for his crimes or not. Brain’s lawyers had said that Brian’s sudden singing in court, was proof of the fact that he was mentally unstable. But the US District Judge Dale Kimball was not convinced, and he said that the singing was merely a ploy used by Brian to give the impression to everyone that he is not mentally fit. “Although the defense has suggested that Mitchell’s singing is a psychotic response to stress, Mitchell has repeatedly demonstrated that he has the capacity to be composed and in control, even in stressful situations,” the judge wrote.
It may be recalled that Brian David Mitchell had kidnapped Elizabeth Smart, and had even fathered 2 children with her. Ed Smart who is the father of Elizabeth Smart, was thrilled to bits, when he heard the landmark ruling that Brian was fit enough to be tried in court. He said that Brian is competent, and he is crazy like a fox.
