Larimer County, Nov 12 (THAINDIAN NEWS) The infamous Richard Heene and his wife Mayumi Heene will plead guilty to several offenses, as they had created a hoax that their minor son had flown away in a home made balloon. Richard Heene’s attorney released a statement that said that Richard and Mayumi Heene will plead guilty on Friday morning in Larimer County Court.
Mayumi Heene will plead guilty to ‘False Reporting to Authorities’, which is a class 3 misdemeanor (and actually it is the lowest level misdemeanor in Colorado law) and it has only a stipulated sentence of probation.
Richard Heene will plead guilty to ‘Attempting to Influence a Public Servant’, which is a class 4 felony. The prosecutor has stipulated to a sentence of probation.
It remains to be seen if the Heenes would actually serve jail time or not, because theoretically they could receive jail time for the charges, however the prosecutor has recommended probation, Richard Heene’s attorney said.
As Mayumi Heene is a citizen of Japan, so her misdemeanor could result in her getting deported, because her husband and her sons are American citizens. prosecutors insisted upon a package deal where Richard would have to take a felony plea willingly, despite the fact that he made no incriminating statements to law enforcement agencies and even Mayumi’s statements could not be used against him.
Upon reviewing all the evidence it was clear that, Mayumi could be deported at maximum and Richard Heene’s case would have proceeded to trial with a very good possibility of his acquittal. So they agreed on the package deal so that Mayumi doesn’t have to be deported as her children would then be bereft of a caring mother.
