Albany, NY elderly woman sentenced for driving into a daycare center while intoxicated and injuring a woman

ALBANY, NEW YORK (BNO NEWS) – A New York elderly woman was sentenced for driving into a daycare center while intoxicated, prosecutors said Thursday.

Marion B. Albert, 78, of Albany, New York, backed her truck out of her driveway on August 20, 2009, floored it across the street, accelerated up and over the curb, across the sidewalk, and crushed a female victim into a daycare center located at 43 Quail Street in Albany.

Albert, who had a BAC of .25% at the time her blood was drawn, drove her truck through the wall of the daycare center and partially into the room where the infants were located. The female who was run over suffered a left femur fracture and hip fracture requiring surgery and on-going treatment.

Albert was previously convicted for backing out of her driveway drunk towards the Daycare Center, but during the May 2009 incident, she hit a truck parked in front of the daycare and her BAC was .18%. Unfortunately, the truck was not there on August 20, crushing a victim and driving through the daycare center.

“DWI is a crime that is easily committed by people despite age, race or status. All you need is alcohol, access to a vehicle and poor judgment. And in each case, the driver makes a conscious choice to get behind the wheel with the results being equally as deadly. Any individual who drives drunk in Albany County, despite their age or any other factor, will be held responsible for their actions,” District Attorney P. David Soares said.

Albert was sentenced to 2 1/3 to 7 years in State Prison and $15,000 restitution.
