The apex court bench issued the summons while hearing into the petition filed by Tikka Iqbal in which he has challenged the declaration of emergency by the Chief of Army Staff arguing that only the President, not chief of the Army Staff, have the authority to enforce the emergency.
The SC issued notices to the concerned parties and adjourned its hearing till November 15, The News reported.
Chief Justice of Pakistan Abdul Hameed Dogar had constituted the SC full court bench to hear this case.
Yesterday, Musharraf defended the decision to impose emergency rule and insisted he had done nothing wrong and did not violate the constitution.
“I stand by it because I think it was in the national interest,” he said.
Nine days ago Musharraf had imposed emergency rule, suspending the Constitution and firing the Supreme Court’s Chief Justice Iftikhar Muhammad Chaudhry.
His allies’ abroad and political opponents in Pakistan have been calling for the emergency to be lifted as soon as possible. (ANI)
