May 12 (THAINDIAN NEWS) Despite the defense teams arguments that execution was a gender biased punishment in this case, that Judge Belvin Perry made his decision on Tuesday; if Casey Anthony is found guilty of murdering her two year old baby girl, she can face the death penalty.
The defense lawyers fighting for Casey Anthony fought diligently to try and keep the death penalty off the table. Their claim was that the death penalty is sexist and that the prosecution was using the chance of execution to bankrupt the defense. Anthony’s attorneys also argued that “Societal biases against women provide the state with a way of deflecting attention away from the insufficiency of the evidence in Miss Anthony’s case,” according to the defense motion. Judge Perry disagreed with the arguments and felt that the defense had not proven their case of gender bias in regards to the death penalty being allowed in the case. Judge Belvin Perry stated, “I find that the defense has not met their burden in this case. The motion to preclude the death penalty for the impermissible gender bias will be denied.”
Casey Anthony has been charged with the first degree murder of her daughter, Caylee, who never reached her third birthday. Caylee disappeared in the summer of 2008, and her remains were found in December in a wooded area near the Anthony home. Casey is the first mother in Orange County who will possibly face the death penalty for killing her own child.
