Brit teacher who had sex with 15-yr-old boy walks free
March 8th, 2011 - 6:14 pm ICT by ANILondon, Mar 8 (ANI): A schoolmistress in Britain, who bedded a 15-year-old boy, has walked free after a judge ruled that the lad had made the first move.
Teaching assistant Leah Davies, 29, slept with the boy after they watched a DVD together and drank vodka during a sleepover party while his mother was asleep upstairs.
The affair came to light when the teenager, who cannot be named for legal reasons, later confided to his aunt about the fling and police were called in.
The mum-of-one was convicted of four counts of sexual activity with a child but she escaped jail after the judge ruled the boy had not been “corrupted” by their illicit affair.
At Manchester Crown Court, Davies was given a 12 months suspended sentence for two years plus a 24-month supervision order after Judge Martin Rudland said she was an “ordinary, decent, hard-working woman” who “made a tragic and foolish mistake”.
“There have been cases in which the power in a relationship has been imbalanced, with the younger person having less. But that’s not this case here,” the Sun quoted the judge as saying.
“The complainant, if he can be described as such, was a gregarious young man who played in a band and was sexually experienced.
“The experience was short-lived and required no coercion and resulted in a degree of sexual satisfaction for both parties. He touched you first.
“He was not seduced or corrupted by the experience. In the whole experience he says he has been mostly upset at the effect on his mum’s friendship with the defendant,” he added.
Earlier the trial was told she first kissed the boy in autumn 2009 and on another occasion performed a sex act on him while he was wearing his school PE shorts.
The boy described them as having a friendly relationship and said he was close with her ten-year-old son.
Davies now 30, of Fallowfield, Manchester, who is now working as a cleaner, denied any wrong doing claiming the boy, now 16, was “attention seeking”.
She admitted being a “warm and tactile person” but that it was never inappropriate. (ANI)
