Ghaziabad, Nov 15 (IANS) Ajay Katara, the prime witness in the Nitish Katara murder case, continued to be in jail despite being granted bail Nov 12 in a kidnapping case as the prosecution moved court seeking verification of the bail surety, said Nitish’s mother Neelam Katara Saturday.”It normally doesn’t happen. But to detain him in jail for as long as possible, influential persons are creating snags in his smooth exit,” alleged Neelam Katara.
On Wednesday, District Judge V.C. Gupta granted bail to Ajay Katara on a surety of Rs.50,000 and a personal bond. The bar was closed due to condolence meeting Nov 13, while Nov 14 was a local holiday, she said.
On Saturday, Ayub Ali, a lawyer assisting the prosecution, appeared before the court of Additional Chief Judicial Magistrate Anil Yadav and submitted an application for the verification of the surety.
Ayub Ali said there are high court directives to verify the sureties above Rs.25,000. The surety was for Rs.50,000 in Ajay Katara’s case.
But Neelam Katara said if the high court directives were mandatory, there was no need for the lawyer to seek the verification as the court could have itself initiated it.
Katara was lodged in jail Oct 3, 2008, on a kidnapping complaint filed by Dharmendra Yadav, who was allegedly close to Uttar Pradesh politician D.P. Yadav, father of Vikas Yadav, the chief accused in the Nitish Katara murder case who has been awarded a life term.
Dharmendra himself was wanted by the Uttar Pradesh police in a case of attempt to murder lodged by Ajay Katara at the Sihani Gate police station in Ghaziabad.
On Oct 6, two security guards of Ajay Katara - Sachin and Ramvir - were arrested.
The district judge granted bail to Katara’s two security personnel on the submission of two sureties of Rs.25,000 each, said Neelam Katara.
