‘To charge abetment to suicide, instigation need be proved’
January 15th, 2010 - 10:31 pm ICT by IANSNew Delhi, Jan 15 (IANS) The Delhi High Court Friday ruled that the charge of abetment to commit suicide cannot be laid against a person merely because he was having bad relations with the victim, unless intention to instigate suicide is proved.
“The charge under section 306 (abetment of suicide) cannot be framed unless it is proved that the accused had intention to instigate the deceased to commit suicide,” Justice V.B. Gupta said, quashing a lower court’s order which had allowed the charge to be laid against a man whose cousin committed suicide.
The petitioner, Dinesh was involved in a family dispute with his cousin Deepak and they had regular quarrels.
Dinesh visited Deepak’s house one night and the two again exchanged hot words. Dinesh then left and soon after his departure, Deepak committed suicide.
Police then framed charges against Dinesh for abetment to suicide, saying he had harassed and tortured Deepak.
The high court, however, found no evidence to allow charges to be framed against Dinesh under section 306 and quashed the verdict.
