Suspended top official moves court
March 25th, 2010 - 10:10 pm ICT by IANSNew Delhi, March 25 (IANS) Suspended chairman of the All India Council for Technical Education (AICTE) Thursday approached Delhi High Court challenging his suspension after the Central Bureau of Investigation (CBI) slapped a case of corruption on him.
Ram Avtar Yadav filed the petition challenging his suspension.
At present, Yadav’s role in the AICTE corruption racket is being probed by the CBI which conducted a series of raids against several key AICTE officials.
A case of cheating and another under the Prevention of Corruption Act was lodged against him and three others last year for allegedly demanding money for processing the case of increase in intake of seats of an engineering college Echelon.
However, a division bench of Justice Anil Kumar and Justice M.C. Garg asked Yadav to file some relevant documents to support his case and posted the matter for April 8.
Appearing for the central government, advocate Atul Nanda said: “The suspension of Yadav is well within the law.”
Yadav had challenged that when his appointment was done with the approval of the Appointments Committees of the Cabinet (ACC) then the same would also be mandatory for suspending him.
On this, the court said: “Approval of ACC is the internal working of the government and if the government can appoint then it has the right to remove anyone also.”
