Police get 90 more days to file charges against Ghandy

New Delhi, Dec 21 (IANS) The Delhi Police were Monday given 90 more days to file a charge sheet against Communist Party of India-Maoist (CPI-Maoist) leader Kobad Ghandy.
Chief Metropolitan Magistrate Kaveri Baweja agreed to Delhi Police’s plea and dismissed an application of Ghandy for statutory bail.

“I considered the ground spelt out in the application, on which extension period of the limitation has been sought. It appears to be just and in view of the report of the prosecutor I am satisfied that it is not possible to complete the investigation within the prescribed period,” said the court while posting the matter for Feb 18.

Under the provisions of Criminal Procedure Code, the investigating agency has to complete the probe within 90 days in case of severe offences. But the court, using its discretion, is empowered to extend the period of detention beyond that.

In an application filed before the court, Delhi Police’s Special Cell, which is investigating the case of Ghandy, submitted that it needed more time to file a charge sheet against him.

Ghandy has been booked for various charges under the Unlawful Activities (Prevention) Act after his arrest Sep 20.
