Plea for CBI probe into corporate ministry theft (Lead)

New Delhi, Jan 24 (IANS) A finance company has moved the Delhi High Court seeking a Central Bureau of Investigation (CBI) probe into the theft from the ministry of corporate affairs of documents related to a case involving a Delhi-based hotelier, a lawyer said Tuesday.
VLS Finance, a non-banking finance company, in its plea filed Monday, alleged the documents related to hotelier S.P. Gupta. It alleged that a police case against Gupta was withdrawn allegedly at the behest of Home Minister P. Chidambaram, his former lawyer
In its application, the company alleged that the files couldn’t have been stolen without officials of the corporate affairs ministry being involved.
Lawyer for VLS Finance said that the company in its petition said that Gupta had created pressure on the probe agency and was interfering in the investigation by seeking closure of the case by misusing government machinery.
VLS is the company that opposed the withdrawal of prosecution against S.P. Gupta. It is alleged that a first information report against him was withdrawn allegedly at the behest of Chidambaram.
It sought investigation by the CBI and production of the case diary and other letters and records showing interferences in the investigation by S.P. Gupta.
Delhi Police hurriedly filed the charge sheet against Gupta in order to help the accused and avoid transfer of probe of the case to the CBI for proper investigation into all aspects, said the company.
“It is pertinent to note that not a single accused was arrested nor put to custodial interrogation in such a serious case, where government of India’s files had been removed by the accused from the ministry and recovered from the residence of the accused,” it said.
