New Delhi/Thiruvananthapuram, Jan 3 (IANS) The Supreme Court Tuesday dismissed the bail plea of Peoples Democratic Party (PDP) chairman Abdul Nazir Maudany, an accused in the 2008 Bangalore blast case. It also denied his plea for medical treatment in Kerala.

An apex court bench headed by Justice P. Sathasivam said: “We are not inclined to enlarge him on bail.”

When senior counsel Sushil Kumar appearing for Maudany asked the court to add that they were not inclined to enlarge him on bail at “this stage”, the court declined the request saying in that case, “some one will move the court again in February”.

It also rejected his plea to be sent to Kottakkal Arya Vaidya Sala in Kerala for ayurvedic treatment and directed the Karnataka government to provide him all the medical treatment needed for his ailments.

When Sushil Kumar told the court that treatment that was being given to Maudany at Kottakkal Arya Vaidya Sala was not available in Karnataka, the court observed: “Let the doctors say so that they don’t have sufficient infrastructure to treat him there.”

At this, senior counsel M.N. Krishnamani appearing for Karnataka government told the court that the treatment being given at Kottakkal Arya Vaidya Sala was also available in Bangalore and Maudany was treated there last year.

Saying that it was not inclined to accept such a suggestion (by Maudany’s counsel), the court said that the petitioner could not choose the place of his treatment and directed the jail authorities to take Maudany to the hospital where the type of treatment he was seeking was available in Bangalore.

“You are interested in a better treatment, you can’t identify the treatment centre,” the court told Sushil Kumar when he said that his client could be taken to Kottakkal Arya Vaidya Sala in Kerala being escorted by state police.

Making obvious its apprehensions, the court said, “What a person may not do physically. By sitting at a place, he can do wonders.”

Maudany was arrested Aug 17, 2010, in connection with the conspiracy for the Bangalore bomb blast.

In Thiruvananthapuram, top PDP leader Poonthura Siraj, who is a close relative of Maudany, said the rejection of his bail application is most unfortunate.

“None in this country would have suffered like Maudany because it appears this is going to be another ‘Coimbatore in the making’,” Siraj told reporters.

Maudany was let off after being an undertrial prisoner in Coimbatore jail from 1998 to 2007 in the Coimbatore serial bomb blast case of 1998.

“Our party leadership will meet at Kochi Thursday to decide the future course of action to be adopted in this new development. We are certain to continue our legal efforts to see justice is delivered to him,” Siraj said.
