Land scam: CBI joint director appears in court (Second Lead)

New Delhi, Jan 12 (IANS) A Central Bureau of Investigation (CBI) joint director Thursday appeared in a Delhi court and told it that efforts were being made to trace missing documents related to an alleged multi-crore rupees land scam here.

The Delhi High Court, earlier in the day, gave a reprieve to the probe agency’s director and allowed a joint director to appear in his place in the trial court over the missing documents.

The case related to Delhi Vidhan Sabha canteen’s former contractor Ashok Malhotra, who was arrested Aug 6, 2007 along with Municipal Corporation of Delhi and Delhi Development Authority officials for allegedly conspiring to acquire plots - in Molarband in south Delhi and Dheerpur in north Delhi - meant for resettlement of slum dwellers.

The trial court had issued notice to CBI director to explain the circumstances in which facts regarding the missing documents were suppressed.

Special Judge A.K. Mendiratta asked the CBI joint director about the missing documents. The official assured the court that the probe agency will traced the missing documents of the case within two weeks.

Judge Mendiratta said that personal appearance of the official was not very important, but the document, including statements of witnesses, should be recovered.

The CBI submitted an application mentioning that 227 documents were recovered and the remaining 10 documents would be placed before court soon.

The joint director told court that the probe agency was going to take action against the authority concerned for the missing documents.

“The matter is of exceptional nature as the sensitive documents relating to the case have not been placed along with the charge sheet and are stated to be missing,” the court had said.

The high court earlier said “it would be difficult for the director of the CBI to appear personally before the trial court as he has to oversee entire function of the agency”.

“Joint director of the CBI would appear before the trial court instead of CBI director, the order of trial court dated Dec 21, 2011 is modified to that extent,” Justice Suresh Kait ruled.

“The CBI should ensure that it shall provide complete details and assistance to the trial court,” the high court said.

The CBI director had Wednesday moved the high court against the trial court order asking him to personally appear before it.
