Justice Dinakaran will have to go on leave, says Moily
April 8th, 2010 - 8:30 pm ICT by IANSNew Delhi, April 8 (IANS) Union Minister for Law and Justice M. Veerapa Moily Thursday said Karnataka High Court Chief Justice P.D. Dinakaran is not above the law and he will have to abide by the Supreme Court Collegium’s advice to proceed on leave.
“I don’t think Justice Dinarakan is above the law, or he is beyond the reach of the law,” Moily told reporters here.
He said this in response to a query on what the government proposed to do on Justice Dinakaran defying the advice of the collegium - a panel of five seniormost apex court judges headed by the Chief Justice of India - to go on leave.
The apex court panel last week recommended that Delhi High Court Acting Chief Justice Madan B. Lokur be appointed in Justice Dinakaran’s place. Justice Dinakaran was asked to go on leave owing to the state high court facing an administrative problem.
Justice Dinakaran had earlier been asked not to conduct any judicial proceeding. Since December, he has been supervising only the administrative work of the court.
He is facing serious allegations of corruption and land grab.
