India to approach Portuguese court on Salem extradition (Lead)
January 25th, 2012 - 5:01 pm ICT by IANS ( Leave a comment )New Delhi, Jan 25 (IANS) The Delhi Police Wednesday told the Delhi High Court that India will approach the Portuguese constitutional court to challenge the Portugal Supreme Court’s cancellation of underworld don Abu Salem’s extradition.
Additional solicitor-general (ASG) Haren Raval, appearing for Delhi Police, told the court: “The whole extradition process is in jeopardy. The CBI (Central Bureau of Investigation) is going before the constitutional court of Portugal against the decision of the Supreme Court of that country.”
Recently, the Supreme Court of Portugal rejected India’s appeal and cancelled the extradition of Salem, saying the CBI had violated the extradition treaty between the two countries.
The petition filed by Delhi Police sought withdrawal of stringent charges under the Maharashtra Control of Organised Crime Act (MCOCA) against Salem, who is undergoing trial in the 1993 Mumbai serial blasts case.
However, Justice Mukta Gupta refused to hear the matter and referred it to another bench, saying she had once appeared before the high court as a lawyer in a case related to Salem.
