Ghandy wants lawyer during interrogation, court defers ruling
October 9th, 2009 - 9:27 pm ICT by IANSNew Delhi, Oct 9 (IANS) A city court Friday reserved its order on a plea of Kobad Ghandy, the arrested leader of the banned Communist Party of India-Maoist, to allow his lawyer to be present during police interrogation.
Chief Metropolitan Magistrate Kaveri Baweja after hearing the Central Bureau of Investigation and Ghandy’s counsel reserved the order for Oct 12.
Delhi Police opposed Ghandy’s plea saying that the very purpose of the Unlawful Activities (Prevention) Act would be impeded if counsel is allowed during interrogation.
Vishal Gosain, appearing for Ghandy, said that as a fundamental rule any arrested person can seek legal help during interrogation.
Ghandy, whose release was demanded by Maoists in exchange for abducted Jharkhand police official Francis Induwar, has been sent to police custody till Oct 15.
Ghandy was arrested Sep 21 from Delhi. Maoists beheaded Induwar Oct 6 and dumped his body off Jharkhand’s Ranchi-Bundu highway.
The 63-year-old London-educated Ghandy, arrested under the Unlawful Activities (Prevention) Act for being a member of the banned terror organisation, was residing at a rented accommodation in south Delhi and allegedly working to set up a base for the Maoists in the capital.
