Ghandy approaches high court challenging narco test (Lead)
November 4th, 2009 - 8:24 pm ICT by IANSNew Delhi, Nov 4 (IANS) Communist Party of India-Maoist leader Kobad Ghandy Wednesday approached the Delhi High Court challenging a trial court order permitting a narco test on him.
Filing the petition through his counsel Redecca M. John, Ghandy cited a Supreme Court case which says that consent of a person is necessary before he undergoes narco test.
The petition also states that the court cannot force anyone to undergo such tests. The petition is likely to be heard Thursday.
The trial court had Oct 31 allowed the Delhi Police to conduct narco test on the 59-year-old Ghandy after the police contended that they had not been able to elicit all information from him despite the use of scientific methods of interrogation.
The court allowed the narco test after a panel of doctors from the All India Institute of Medical Sciences (AIIMS) told the court that Ghandy was fit for the test.
The Maoist was arrested Sep 21 and is in judicial custody.
