Family of accident victim gets Rs.10 lakh compensation
April 21st, 2011 - 7:16 pm ICT by IANSNew Delhi, April 21 (IANS) A Delhi court has awarded around Rs.10 lakh compensation to the family of a man who was killed in a road accident in 2007.
The court, in an order given April 18, held the driver of the vehicle responsible for the accident guilty under the Motor Vehicles Act.
Motor Accident Claim Tribunal Judge Ashwani Sarpal awarded Rs.804,520, apart from around Rs.2 lakh interest, to the family members of 35-year-old victim Surya Prakash.
The motorcycle on which he was riding as pillion was hit by Harish Kumar’s van in 2007.
“A driver behind the wheels of a mechanically propelled vehicle is under bounden duty to observe necessary caution for avoiding striking other vehicles…having struck the motorcycle of the petitioner, causing grievous injuries on his person, Harish Kumar was berserk and thus negligent,” the court said.
The court directed the insurance company to pay the awarded sum within a month along with an interest of 7.5 percent per annum from the date when the case was filed in June 2007. The interest would add up to around Rs.2 lakh.
Surya Prakash, who worked as a driver-cum-businessman, was killed June 21, 2007, around 4.30 p.m. while going towards Okhla Industrial Area Phase-I in south Delhi. The van came from the opposite direction and hit the motorcycle.
The impact was so strong that the driver of the motorcycle and Surya Prakash fell down. They were rushed to hospital where Surya Prakash succumbed to his injuries. The motorcycle driver recovered after the incident.
While filing the petition, Surya Prakash’s wife sought Rs.30 lakh compensation.
