Court to hear Tiwari paternity suit July-end
May 20th, 2010 - 9:22 pm ICT by IANSNew Delhi, May 20 (IANS) The Delhi High Court Thursday decided to frame in July the issues to be adjudicated by it in the paternity suit filed against veteran Congress leader N.D. Tiwari by a young man claiming to be his biological son.
Justice J.R. Midha asked all the parties to file their responses to Tiwari’s reply to the paternity suit and fixed July 30 as the next date of hearing.
The court order came after the apex court had refused to stay the proceedings against the 84-year-old Congress leader.
The apex court had May 10 dismissed the appeal filed by Tiwari challenging the high court’s decision to adjudicate on the paternity suit.
The counsel for Rohit Shekhar, who has filed the paternity suit, again pleaded before the court that Tiwari should undergo the DNA test at AIIMS as that will act as a strong piece of evidence.
Shekhar claimed he was born out of a relationship between his mother Ujjwala Sharma and Tiwari, a charge denied by the Congress leader and former Andhra Pradesh governor.
In an affidavit filed in the Delhi High Court, Tiwari said that he did not have and never had any physical relationship with Sharma, who is also a Congress leader.
Earlier, the court had dismissed the plea by Tiwari who sought dismissal of the petition on the ground that it was filed 31 years after the petitioner was born in order to malign his character.
