Court tells police to trace, reunite minor boy with mother (Lead)

New Delhi, Dec 13 (IANS) The Delhi High Court Tuesday directed the police to present before it by Dec 15 a two-year-old boy whose mother alleged that he had been forcibly taken away by her husband due to their marital discord.

The child’s mother, who lives separately from her husband in a rented house in west Delhi’s Dwarka, told the court that she was illegally deprived of her son’s custody.

A division bench of Justice B.D. Ahmed and Justice Veena Birbal directed police to present the child before it Dec 15 after taking cognizance of the habeas corpus plea filed by the child’s mother.

The mother alleged her son was taken away in a criminal manner and sought his custody on the ground that she was his natural guardian.

The petition alleged the child’s father took him away Dec 8 from her house in her absence.

“The respondent (husband) took away the child and all other valuables in her absence and she was telephonically informed about the same,” the petition said.

On the same day, she went to the east Delhi residence of her husband and his parents but the door of the house was not opened.

“The life of the child is not safe in the hand of the father and the child as well as the petitioner (mother) is undergoing physical and mental torture,” her lawyer O.P. Saxena said.

In the petition, the child’s mother also accused police of shielding her in-laws.

The parents of the child got married Nov 30, 2008 and the boy was born the same day the next year. She said later her in-laws forcibly separated her from her husband.
