Court slams Tiwari for avoiding test (Lead)

New Delhi, July 7 (IANS) The Delhi High Court Thursday slammed Congress leader N.D. Tiwari for flouting its order and not giving blood samples for a paternity test in a suit filed by a 31-year-old claiming to be his biological son.

“How can Tiwari flout the court’s order even after he was directed to give his blood sample?” Justice Gita Mittal asked.

Pulling up Tiwari, Justice Mittal sought to know if there were any health or medical problems that prevented him from giving the samples.

“You have to file an affidavit, if you say that your client has a medical problem,” said the court, adding the blood samples will have to be given.

“I am not going to hear any clarification, order of the court has to be complied with and just cannot be flouted,” said the court.

Justice Mittal took note of two petitions filed by Rohit Shekhar, seeking prosecution of the 86-year-old politician for non-compliance of the high court order, duly endorsed by the Supreme Court.

The court adjourned the matter till July 11.

Rohit moved the court for initiation of contempt proceedings Wednesday against Tiwari after he refused to give his blood sample for the DNA test.

The court said: “You (counsel for Tiwari) take instruction from your client as to why he is not willing to comply with the court`s order. Tiwari will have to give his blood sample for DNA test.”

Tiwari’s five-decade political career virtually ended in 2009 after a news channel showed explicit clippings of an elderly man purported to be Tiwari with three young women in bed.

A few days later, Tiwari resigned as the Andhra Pradesh governor on health grounds.
