Court slams firm for illegal construction by misleading MCD
November 17th, 2009 - 9:59 pm ICT by IANS ( Leave a comment )New Delhi, Nov 17 (IANS) Coming down heavily on a building firm which carried out illegal constructions by misleading the Municipal Corporation of Delhi (MCD), the Delhi High Court Tuesday asked it to pay the civic agency a fine of Rs.200,000.
Justice Gita Mittal slammed Chiranji Properties Ltd for misleading the Lt Governor and the MCD by asking for de-sealing of its property to carry out rectification in the building, but instead constructing an entire floor.
“The petitioners had obtained an order of de-sealing for the reason that rectification of the property was to be undertaken and thus misused the de-sealing for the purposes of raising further unauthorised construction. The present case is a fit case whereby the MCD deserves to be compensated for the costs as well as judicial time taken on this aspect of the matter at the instance of the petitioners,” the judge said.
“The petitioners are directed to pay Rs.200,000 to the MCD,” the court said while asking MCD’s executive engineer (south zone) to de-seal the property for one week so that all construction undertaken after March 14, 2007, can be demolished.
The court was hearing the petition by Chiranji Property whose property in Krishna Nagar in east Delhi has been sealed by the MCD after the agency found illegal construction was going on there.
