Court serves notice in nurse’s certificate case

New Delhi, May 11 (IANS) The Delhi High Court Wednesday issue notice to the union government, the Delhi government and Indraprastha Apollo Hospital over a petition seeking the release of the original certificates of a nurse from the hospital.

A division bench of Chief Justice Dipak Misra and Justice Sanjiv Khanna issued notice to all the three respondents seeking their reply by July 20.

The court issued the notice while hearing a petition of Ancy N.

Jose Abraham, the nurse’s lawyer, told the court that “the original certificates of Ancy are in the illegal custody of Apollo hospital. She has to go back to Kerala because her mother, a cancer patient, is seriously ill.”

Ancy completed her nursing degree course from reputed institution and got registered as qualified nursing professional, said the petition.

She was interviewed Feb 2 by the Apollo hospital authority and was appointed as a staff nurse March 1.

“During the process of admission the Apollo had demanded all the original certificates of her academic qualification. They have also taken her original B.Sc (nursing) degree certificates and nursing council registration certificate,” the petition added.

The action of the respondent in keeping the original certificates of the petitioner amounts to naked violation of the right to work and freedom of movement guaranteed under Article 19 of the Constitution of India and it is a violation of the principles of natural justice, the petition charged.

Taking note of the petition, the court said: “How can you make a nurse a slave, she is not your slave.”

“Doing the job is her fundamental right. How can you stop her from doing so,” asked the bench.
