Court restrains school from seeking hiked quarterly fees
February 23rd, 2010 - 8:50 pm ICT by IANSNew Delhi, Feb 23 (IANS) Restraining a school in the capital from demanding hiked fees on quarterly basis instead of monthly, the Delhi High Court Tuesday directed it to stop this practice.
Hearing the petition of 10 aggrieved parents who had approached the court against the discriminatory attitude of Summer Field Public School, Kailash Colony, Justice S.N. Aggarwal issued a notice to the school and asked it not to charge fees from children on a quarterly basis.
“The school is restrained from striking off the names of the wards of the petitioners from the rolls and is further directed to issue admit cards to all class 10 and 12 students,” the order stated.
The court directed the school to file its reply by March 23.
Counsel for the parents Ashok Aggarwal pleaded before the court that, “the practice on the part of the school to compel the parents to deposit fees cheques on quarterly basis besides being contrary to the letter and spirit of the provisions of the Delhi School Education Act, 1973, and the rules made thereunder, is exploitative in character, and tantamounts to commercialization of education, which is prohibited in law.”
According to the parents, they have been depositing the fees with the school earlier on quarterly basis. But due to heavy payment of arrears because of the hike in fees, they are not in position to pay the fees according to the previous structure.
Though the school kept on taking the fees, it issued a letter that if fees are not paid according to the rules names of their wards would be struck off the rolls.
