The division bench comprising Chief Justice S.J. Mukhopadhaya and Justice J.B. Pardiwala issued notices to the government and the officer on special duty to the governor.
The court noted that as per the Protection of Human Rights Act, the process of appointment of members of the state commission had to be initiated by the governor’s office.
NGO Yogkshem Foundation for Human Dignity filed the petition seeking appointment of chairperson and two other members in the SHRC. The NGO claimed that all three posts in the SHRC were vacant since February .
The case would come up next July 4.
