New Delhi, Aug 24 (IANS) A city court Monday pulled up a lower court for dismissing a case demanding action against former city mayor Arti Mehra and others for giving false affidavits.
“The trial courts should be cautious while dealing with such allegations and under no circumstances should an impression be given that the parties to the litigation can easily get away or else it will shake the confidence of the people in judicial institution,” Additional District Judge Kamini Lau said.

Hearing an appeal by Gian Chand Gautam against a trial court’s order dismissing his plea to prosecute Mehra and six others for allegedly claiming a disputed park at Gautam Nagar, the court sent the matter to the trial judge and asked it to decide on the maintainability of the case after giving opportunity to parties to record their statements.

“Surprisingly, the trial court had failed to take note as to how the same error (regarding measurement of the park) was committed by one and all despite having taken a stand in their affidavits,” the judge said, expressing surprise as to how former mayor Mehra and the Municipal Corporation of Delhi’s (MCD) zonal engineer could claim to be unaware of the ground realities regarding measurement of the park in question.
