Court dismisses plea over missing soldier
January 14th, 2010 - 9:45 pm ICT by IANSNew Delhi, Jan 14 (IANS) The Delhi High Court Thursday dismissed the plea of the son of a missing Indian soldier suspected to be in a Pakistani jail for 44 years after the government said they had failed to trace him.
Submitting before Chief Justice Ajit Prakash Shah and Justice Rajiv Sahai Endlaw, government counsel Jatan Singh said: “A delegation of relatives of the petitioners did visit 10 jails in Pakistan but could not find any trace of the said prisoner (Anand Patri).”
“Even the tri-service committee’s meeting had been held and this case had been closed because petitioners did not give any details of the prisoner,” Singh added.
“The court has certain limitations on jurisdictions with regard to public interest litigations,” the bench said while dismissing the plea.
In an earlier report, the government contended that it had no record of Patri after the 1965 India-Pakistan war.
The court was hearing a public interest litigation filed by human rights activist Madangopal Khushiram Paul and lawyer Kishor Paul.
