New Delhi, July 31 (IANS) A city court Thursday awarded a compensation of Rs.11.5 million to the family of a Non-Resident Indian (NRI) who was killed in an accident when his car collided with a tractor on the Delhi-Gurgaon road eight years ago. Motor Accident Claim Tribunal (MACT) Judge Swarna Kanta Sharma directed tractor owner Mohd Sahid and driver Mohd Hanif to pay Rs.11,534,000 with an interest of 7.5 percent to the NRI family within 30 days.
Rajesh Khetrapal, who was working as a Master in Wallen Ship Management Ltd of HongKong, died in an accident. He was returning, along with his wife and two minor children, in his car from Gurgaon to Delhi Nov 19, 2000, when it collided with the tractor.
Shelly Khetrapal, wife of the victim and his two children, filed the petition.
Khetrapal, the NRI, who used to remain out of the country for six months in a year, was earning Rs.190,000 per month from his job.
The court rejected Sahid’s plea that the tractore was not owned by him as it was registered in the name of Chand Ram.
On his part, Ram, however, produced documents to show that he had sold the vehicle to Sahid Oct 9, 2000, a month before the accident.
He also showed that Sahid had got the vehicle released on a bond from a Gurgaon court, which is conducting criminal trial for the accident.
