Court allows expelled student to sit for examination
February 26th, 2010 - 6:07 pm ICT by IANSNew Delhi, Feb 26 (IANS) The Delhi High Court Friday allowed a Class 11 student expelled from his school for allegedly molesting a girl to sit for his final term examination.
Justice G.S. Sistani stayed the expulsion order served on the student by the Chander Shekhar Azad Sarvodya Bal Vidyalaya, New Friends Colony, subject to the condition that the petitioner does not enter the school premises except for giving his examination. “The examination of the petitioner shall be held in the office of the principal of the school and the school will issue an admit card to the petitioner,” the court said.
The student was allegedly involved in molesting a girl from the northeast when she was passing by the school in a rickshaw Oct 22 last year.
Following this, the school expelled the student, who then approached the high court challenging his expulsion. His counsels A.Z. Chaudhary and Abdul Qadir told the court that the school did not issue any notice nor was any hearing granted to him to explain his stand.
“The order of expulsion could not be passed without prior approval of the Director of Education, as per the Delhi Education Rules,” the counsel pleaded.
“In case the student is not allowed to appear in the Class 11 examination, serious prejudice would be caused to him,” the counsel added.
