Book four cops for filing false case: Court
September 13th, 2011 - 11:16 pm ICT by IANSNew Delhi, Sep 13 (IANS) A Delhi court Tuesday acquitted an accused in a 2006 extortion case registered in north Delhi and directed the city police chief to book four policemen and the complainant who implicated him.
“This case is a classic example of how and to what extent the police officers can go in framing persons, committing extortion and then making them suffer the ignominy of criminal prosecution by sheer misuse of power of investigation,” the court said.
The policemen from the counter-terrorism unit Special Cell are Assistant Commissioner of Police Ravi Shanker, inspector Anil Dureja, sub-inspector Gajender and head constable Hari Kishan.
The complainant in the case was Rajiv Pahuja.
“The commissioner of police is directed to lodge an FIR (first information report) against these accused and any other person who is found to have indulged in criminal activity under appropriate sections of law. A copy be sent to him,” said Chief Metropolitan Magistrate Vinod Yadav.
The five people have been accused of allegedly extorting money from people by threatening to implicate them.
The court’s observation came while it was hearing an extortion case registered in Shalimar Bagh.
The court said that the Special Cell which was created to deal with cases of terrorists and anti-social elements was itself implicating innocent people.
“The concerned police officers are of Special Cell, which is supposed to be a premier investigating agency of Delhi Police specially created to deal with the cases of terrorists and anti-social elements,” the court added.
“The police officials have done false investigation by implicating the accused wrongly … They created false records and made false acquisitions against him,” the judge said.
