2G case: Morani moves bail plea (Lead)

New Delhi, Sep 15 (IANS) After spending over 100 days in Tihar Jail here, Cineyug Films’ founder Karim Morani, named as co-conspirator in the 2G spectrum allocation case, Thursday moved a bail application in a Delhi court.

Morani, who is in jail since May 30, filed the bail plea before a special Central Bureau of Investigation (CBI) court, presided over by Judge O.P. Saini, praying that the court should grant him bail.

The court fixed Sep 21 for taking up his bail application.

Morani said he was entitled to bail on the ground that his health condition was not stable.

He said the judicial custody could have fatal consequences or cause damage to his health.

Morani, while seeking bail, said that he would not run away. He claimed the accusations against him in the charge sheet were highly misplaced.

He said that the case was based on documentary evidence which was already in the custody of the CBI.

“So there is no chance of tampering with the evidence or documents,” said the application.

“It is a well settled principle that bail cannot be withheld as punishment, but the requirement of bail is merely to secure the attendance of the accused during trial,” said the application.

Morani was suffering from various ailments for the last 31 years. He had undergone angioplasty in 1991, 1993 and 1997, and had open heart surgery in 2007, the application said.

Morani said he had received a sixth bypass graft and required reboring of his two major vessels. He had also been advised complete rest due to chest pain.

Morani’s anticipatory bail plea was rejected by the court May 23. He then applied for bail, which was denied May 30 and he was taken into judicial custody.

He approached the Delhi High Court seeking interim bail on medical ground, but the plea was rejected July 19. He approached the Supreme Court, which Aug 1 dismissed his plea as withdrawn.
