Human Rights Attorney of the Lawyers Council of Thailand Nitithorn Lumlua (นิติธร ล้ำเหลือ) revealed that the Supreme Administrative Court has ordered a request to revoke the Emergency Decree issued in Bangkok by the Prime Minister to be reviewed by the Constitution Tribunal. The tribunal will also be entrusted with considering the matter of an injunction to temporarily suspend the decree while the matter is being considered.
The Supreme Adminisrative Court has noted that article 16 of the Emergency Decree is beyond its authority and thus must pass through the review of the Constitution Tribunal first.
The Lawyers Council submitted the request for review and an injunction on the behalf of the People’s Alliance for Democracy. The council has also sought civil action against Prime Minister Samak Sundaravej for his issuance of the decree.
