Constitution Tribunal rules Mr. Samak unfit to be PM
September 10th, 2008 - 4:43 pm ICT by Amrit Rashmisrisethi
The Costitutional Tribunal yesterday convened to declare their verdict to conclude Prime Minister Samak Sundaravej’s involvement on atelevision cooking show as well as a morning talk show. The case was brought to the courts attention by Senator Ruangkrai Likitwatana (เรืองไกร ลีกิจวัฒนะ) and the Election Commission.
The tribunal ruled that the defendant in the case held his personal gain above the benefit of the public by continuing to host the television programs while serving as Prime Minister foregoing possible unconstitutionality by receiving payment in alternative forms. The tribunal saw that Mr. Samak was an employee of the television programs and was in a position of personal gain.
Mr. Samak’s testimonials were deemed as incongruent with that of witnesses in the case and the Constitution Tribunal unanimously ruled that he end his duty as Prime Minister. The court however did not suspend Mr. Samak’s Cabinet.
