Swann fails to get drink-drive charge dismissed in court
December 9th, 2010 - 4:24 pm ICT by ANILondon, Dec 9 (ANI): England spinner Graeme Swann has failed in a bid to have a drink-drive charge dismissed in the court.
Swann’s lawyer tried to have the case dismissed on a legal technicality, but a judge ruled that it should go ahead.
An earlier hearing was told police stopped the cricketer in the early hours near his home in West Bridgford, Notts.
He said he had been to a 24-hour supermarket to buy screwdrivers to rescue a pet cat, stuck under floorboards, The Sun reports.
A blood test showed that Swann, 31, had 83mg of alcohol per 100ml of blood. The legal limit is 80mg. He denied drink driving.
Phillip Lucas, defending, argued at Nottingham Magistrates Court that the police nurse took the blood sample used for the reading without Swann’s permission.
District Judge Julia Newton said: “There is a case to answer, in my view.”
The case was adjourned for a two-day trial in February, which Swann is due to attend, The Sun reports. (ANI)
