ICL barred from filing suit against BCCI in UK
February 4th, 2010 - 9:45 pm ICT by IANSNew Delhi, Feb 4 (IANS) The Delhi High Court Thursday restrained the Indian Cricket League (ICL) from filing a suit in British courts to seek damages from the Board of Control for Cricket in India (BCCI).
On a plea the BCCI filed for an anti-suit injunction against Essel Sports Pvt. Ltd. (ICL), the court held that the ICL attempt to file a suit in the British courts against the BCCI, when a suit of Essel was already pending based on similar causes of action, was “unconscionable”.
“Essel Sports (ICL) had sent a legal notice threatening to file a suit in the high court of England and Wales in London, seeking various reliefs, including restraint orders and damages against the BCCI, the England and Wales Cricket Board and the International Cricket Council for allegedly boycotting ICL,” BCCI said in a statement.
Essel Sports had earlier in August 2007 filed a suit in the Delhi High Court against the BCCI, Karnataka State Cricket Association and the Union of India, making substantially the same allegations that were made in the recent legal notice threatening to file another suit in England.
