Karachi, Aug 15(ANI): Pakistan batsman Younus Khan’s legal team has said that a fresh Pakistan Cricket Board (PCB) show cause notice to the right handed batsman for alleged indiscipline would be illegal, as he has already been punished over the issue.

According to reports, the PCB may issue another notice over the fact that the former captain has not contacted them regarding his case after the appellate tribunal of the board lifted ban from him in June.

“Issuing a fresh show cause notice to Younus would be a violation of article 13 of the constitution as no one can be punished for the same offence twice,” The Daily Times quoted Qayyum, as saying.

“The board has already punished him for the so-called misconduct and indiscipline. So, constitutionally he can’t be punished again for the same offence. The board would commit a crime by giving him a fresh notice,” he added.

However, PCB legal advisor Tafazzul Rizvi rejected the claims made by Qayyum, and said that there would be no violation of the constitution if Younus was issued a fresh notice.

“Younus Khan’s case does not count as double jeopardy as he has not been penalized as yet since his ban was removed by the appellate tribunal,” Rizvi said.

Younus along with Mohammad Yousuf was banned indefinitely from the team in March following an inquiry committee report, which had probed Pakistan’s dismal performances and disciplinary problems during the tours of the United Arab Emirates, New Zealand and Australia.

Five other players - Shoaib Malik, Rana Navedul Hasan, Shahid Afridi, Kamran Akmal and Umar Akmal - were also banned or fined.

However, the appellate tribunal later lifted bans on Younus and Malik and halved the fines.

Naved’s appeal is still pending, while Yousuf did not appeal and retired from cricket in protest. (ANI)
