Shiv Sena officials booked for noise pollution
October 7th, 2011 - 4:52 pm ICT by IANSMumbai, Oct 7 (IANS) A case has been registered against three Shiv Sena officials for violating court norms by exceeding the noise level limit at the Dussera rally held Thursday, police said here Friday.
Shiv Sena held its traditional Dussera rally at Mumbai’s Shivaji Park ground — which has been declared a silent zone — after the Bombay High Court granted the party permission to do so on the condition that it abided by the Noise Pollution (Regulation and Control) Rules, 2001, which prescribes noise level of 50 decibels.
“We registered the FIR last (Thursday) night against Diwakar Borkar, Anil Parab and Milind Vaidya who had sought permission from us and later from the Bombay High Court,” a police officer told IANS.
Sumaira Abdulali, an activist, in a written complaint to Mumbai Police Commissioner Arup Patnaik, said the noise levels during the speeches rose and exceeded those permitted by the court.
“The decibel level in Ramdas Kadam’s speech hovered between 61 and 85, while Uddhav’s was between 58 and 77. Bal Thackeray was surprisingly soft: the decibel level was only between 57 and 71,” she said.
Abdulali, however, conceded that the decibel levels were considerably lower than those at last year’s Dussera rally.
The punishment under the Environment Protection Act and Noise Pollution Rules is Rs.1 lakh fine and imprisonment up to five years, she said.
