Poll panel rejects application to form YSR Congress Party
July 9th, 2010 - 8:53 pm ICT by IANSNew Delhi, July 9 (IANS) The Election Commission Friday rejected an application from a native of Kadapa district in Andhra Pradesh to register a political party in the name of former chief minister Y.S. Rajasekhara Reddy.
The commission had earlier twice rejected the application by Mahaboob Basha for registering the ‘YSR Congress Party’. The panel said it could not grant permission as the application was received a month after formation of the party, and not within 30 days, according to the rules.
“Registration as a political party is granted under section 29A of the Representation of the People Act, 1951. As per sub-section 2(b) of aforesaid section 29A, the application shall be made within 30 days following the date of formation of the association or body,” said the commission in a statement.
According to the application, the party was formed Sep 18, 2009. Basha submitted the application for registration Nov 13, 2009, more than a month later.
He requested the poll panel Dec 29, 2009 to reconsider his case, saying that on Sep 18, 2009 an association was formed, and on Nov 5, 2009 it was decided to convert it into a political party.
The commission observed that “the facts as claimed by the petitioners were not borne out from the petition”, and rejected it.
Basha once again submitted the application May 28 this year for reconsideration of his case with new facts, but the panel rejected it.
Meanwhile, the poll panel said it was examining another application received from S. Venkataramana Reddy of Kadapa district seeking to register a political party by the name ‘YSR Praja Party’.
He submitted the application July 5.
