Court to hear legislator’s plea against NDMC
January 27th, 2011 - 11:15 pm ICT by IANSNew Delhi, Jan 27 (IANS) The Delhi High Court Thursday decided to hear a plea of a legislator challenging a resolution of New Delhi Municipal Council (NDMC) to withdraw perks given to him as its elected and non-official member.The division bench of Chief Justice Dipak Misra fixed Feb 22 to hear the petition of legislator Karan Singh Tanwar.
Tanwar has challenged the basis of the NDMC’s resolution last year.
The court asked Tanwar to apprise it about the facilities he was availing as a member of the legislative assembly.
Filing the petition through Subromanium Prasad, Tanwar said that after delimitation, two legislators, including him and Chief Minister Sheila Dikshit, automatically became members of the council as their constituencies fall within the jurisdiction of the NDMC.
Saying that by virtue of the NDMC Act he was a member of council, Tanwar said the chief minister had surrendered the facilities she was supposed to get from the council.
According to the petitioner, the NDMC withdrew some of his perks, including office space, residential accommodation, car and monthly refreshment allowances on the ground that he drew a salary from the assembly as legislator.
