Victims of misuse of anti-dowry law demand Welfare Ministry for men

Bangalore, Jan 20 (ANI): Victims of misuse of anti-dowry law and Section 498A of the Indian Penal Code (IPC), held a protest demonstration here today, and demanded the setting up of the Welfare Ministry for mens.
Members of the Save Indian Family Foundation held the demonstration at the M G Road in front of Mahatma Gandhis statue.
They held placards and demanded redrafting of domestic violence laws and making gender issues neutral. They also demanded a commission to address men’s issues.
“Its not just men, but also women of their family, who are victim of the misuse of anti-dowry laws. In every 10 minutes a husband commits suicide in India, but why that is not considered as domestic violence?” asked Uma Challa, a non resident Indian. (ANI)

I appreciate foreign women because they are not as hypocritical when compared to Indian women. They ask for equality and not for special privileges as women in India ask for. They compete with the guys without asking for reservations, laws, tax concessions etc.

Problems with the section 498A
of IPC are as under:
1. It rewards frauds and cheats for using the law.
2. It makes the accuser the prosecutor, the judge
and the jury all rolled into one.
3. It makes all the families subject to destruction
on the whims and fancies of criminals
(girl and her families who want to get rich).
4. It has no safeguards for the innocent.
5. It facilitates elder and child abuse by the
accusers without any fear of punishment.
6. It lays down no automatic punishments for the
unscrupulous accuser(s), even after it is
proved that the accused persons were innocent
and the complaints were fraudulent.
7. It enables violation of the privacy, sanctity
and the dignity of the innocent families, and
throws the very existence of Indian families to
the vultures in the police force, criminals in
the society and at the mercy of the lawyers and
the inefficiencies of the court system in India.
8. It provides monetary inducements for corruption,
falsehoods, revenge, blackmail and extortion;
therefore an invitation to the increasing crimes
in India.
9. It is a monster and menace, created by the
law; and does not belong in any civilised and
democratic society as it smells like fascism.
10. The guilty who make frivolous and scandalous
complaints or start false prosecutions get off
Scott free at the cost and expense of the public
exchequer
Only fascist dictatorships and enemies of the society create
laws that destroys the very society they claim to protect..

False cases are filed under Sec.498-A without any convictions by the wives? They are just let off, unless the Husband files for defamation against his spouse at the higher courts. Why are not wives jailed or punished for the abuse of Sec. The trauma after such false cases on the boy, his parents, sister, brother and sometimes even small child who is not spared is horrifying. Senior Citizens are jailed without any proofs. Even in Murder cases proofs are required to convict the guilty. Wives just want to settle their scores by asking Hugh amounts from the In-Laws, so that she can withdraw the case. Isn’t such a demand of hers from his husband & In-Laws tantamount to a DOWRY? What a mockery of such a Section, which has been introduced for guarding her from the evils of dowry, is being used by her to extract money in such a way. Cases of Sec.498-A & D.V are filed by the wives (97%-98% are fakes) just to harass her husband & In-laws & majority of them leads to Separation/Divorces. India is the only Country in the World to have such Draconian Laws. India is the only Country in the World where there a plenty of laws for the women & sadly not a single law that protects a man. And finally India is the only country in the World where Husbands & his Parents are jailed without any Convictions / Proofs or Evidences whereas such a thing is mandatory for Murders and other criminal cases. In another decade, India will be the only Country in World where every household will have only women and we will be proud not because of Democracy but sadly Womancracy - To the Women, By the Women & For the Women.

THE MEN TORTURED IN THE HANDS OF WOMEN/WIFE
NOWADAYS men are tortured in the hands of women by misusing newly formulated laws specially designed only for women. The law makers fully forgetting the constitutions article 14 which says all men and woman are equal before law or say equality before law. This article 14 giving equal strength to man and woman but formulating new law for women so for no law formulated by the law makers for men. Why?
A fine case of one Mr. Rathinasabapathy who was married with Rajeswari of Howrah at Pondicherry on 4th June 2003 started their life initially at Pondicherry latter after five months shifted to Bangalore where he was employed. The husband arranged job for his wife and he had given her all possible freedom which include to visit her parental house, to wear the dresses she feel convenient. But his all these freedoms and love showered towards the wife resulted in one fine day with hand cuffs of iron. Do you believe? YES THIS IS A TRUE STORY. The husband who once tried his best to keep his wife happy meted the cruelty by the same women. The husband arranged all physical mental pleasures for his wife but not fulfilled one demand which is affecting his parents, unmarried brother and sister. The wife demand for separate dwelling that too in such a place the language of which is a strange thing to the husband and leaving the old aged sick parents here all alone was not welcomed by the husband and which only resulted in iron hand cuffing like a herded criminal and lying in illegal custody for eight days.
The wife and her parents even not intimated him the child birth and somehow when he come to know the child birth he requested to send a snap of the child which was also not heard. For the new born the father send some gift which was also returned by the wife and her parents. Their cruelty reached at Himalayan peak when she lodged a complaint using the weapon of dowry and domestic violence act (DVA) and several other criminal section against husband and in-laws, the in-laws who never interfered her life. The question is if she really met cruelty by the hands of husband and his relatives why she had not opted to file a complaint in the jurisdiction police station which was only in walkable distance. She opted to file complaint in the Howrah police station and filed a divorce under section 13a and succeeded to get an expartee decree within 3 months of filing which is very impossible as per marriage law. The husband had not given time to file counter or for a counselling. When husband was attending for maintenance case and came out of the court he was arrested and handcuffed and remained in the custody for eight days and ninth day presented before the judicial magistrate and then kept one day in judicial custody and latter bailed out. The wife atlest shown curtsy by not opposing the anticipatory bail of in-laws.
The women how she forget the sweetness of togetherness, how she forget the sweet face of her husband which is now also in front of her in the form of child.
THE MEN WAS CRUSHED IN THE HANDS OF WOMEN. The men who is a M.Sc., M.Phil., earning sufficiently was now staring the sky with no hope for justice. His parents are weeping and sister, brother still in a stage of shock.
The reward paid by the wife to her husband is the only result of misusing of newly formulated laws. The court at Howrah which have no jurisdiction neither to try the suit for divorce nor for the criminal offence as the couple married at Pondicherry and last resided place at Bangalore, where both of them were employed and as such alleged offence held in Bangalore. So the decree which is passed by the Howrah Court is improper and the complaint also liable to be quashed. But these all will happen in future.
Wake and do something for men otherwise similar trouble tomorrow you also have to face. For this not only togetherness of men required but the togetherness of women also required.

Iam a victim of the 498A and the domesticce violence act against women. I was forced to leave my house by my wife’s parents as they came for a surprise visit to my house.
I fly for a domestic airline and affter three days when i went back home to collecct my things i.e. my flying documents and my passport she and her family took everything out of my flight bag and never gave them bacck to me.
When she filed a complaint in the Crime against Women cell once we got time alone to talk to each other where i recorded her saying that her family took away my documents and that all that she wrote in the pettetion of the domestic violence act was her lawyers doing.
In court i flied the transcript of the recording, the court did not take it into account. The high court judge tells me that you should give her the money and settle it cuz you’ll only get a chance to proove yourself after about 5years.
Need some advice as to what should i do? I have all the evidence against her espeacially the recording. Its frustrating.
To make things worst the sessions court has granted her an interim relief of 35,000 ruppees.
Best part is my wife is still driving my car she has taken everything from the house.
Wonedering what to do next.

here i want to discuss all the revenge taken by the women by using the law given to her and made the life of men miserable when he is innocent.
not all but most of the women are now using the law which is given to the past years used as a power to force the men and his family according to her will and deterioate his life completely by giving false statement about the sexual and abusing threats by giving the wrong statement and the dowry is demanded by him or his family member and she puts the men and his whole family behind the bars by using the domestic violence
law even when she tortures them mentally or physically. There is no law given or support to men to protect himself and his family against the cruely of women.
So it is a time for all the men’s to think for themselves and make a society and take the active part in all the men’s related isuues and problems which they are facing and make the government and law makers to see it and takes necessary steps in this regard. As all of see the women cruel nature in our life’s time. SO its necessary to make the society for men’s welfare and development at a state and at a national level.

i married in feb. 2009. after marriage me my wife setteled in chandighar where i was employed, since that time i was being forced by my wife and her family to have no more relations with my parents, and i was forced to make division of my share in house and my father’s savings. while we both were living apart from my parents, i was harresed if i talk to my parents just to know their wellness i was asked not to talk my parents and not to visit my parents home, i have been slaped by my wife many times, due to these problems and mental distubances, i was unable to perform well in my company and my employeer asked me to resigne as became a liabilty for the employer, due to this i lost my job, after loosing my job i setteled in noida to seek a new job, my wife still harresed me many times and abusing my parents, after four months once again i requested my wife to visit my parents house she went with me but she insulted my parents and abused them badly. on the evening of 23rd july she blamed me to beat her and called her parents at my home in noida they came in late night and she went with her parents on 24th july in the very early morning with all jwellery, belonging, clothes and all documents of her. after that she and her parents are threating me file a false case of dowry, me and my family is worried, please suggest me what should i do now, please help me.

Hi Mukesh. Well my wife has complaint to the police and filed a petetion saying that i raped her and used to often sexually abuse her for want of dowry. The sad part is that even when the police knows for the fact that the story is totally false they can’t do anything. Today i visited the crime against women cell and they just point blank told me that why don’t you give your wife the money and go your seperate ways. I asked them that if i was guilty of doing what she has alleged then i would have given the money.But why should i give a woman money when it is based on lies. The shame that one’s family has to go through for no reason of theirs. It is really sad that the Indian judicial system is cannot stand by what is right.

Another classical example of the gross misuse of Dowry Act (498A) is the case of television celebrity, Suhaib Ilyasi. India’s Most Wanted television host was in controversy after the dispute over his daughter Aaliya’s custody rose soon after Ilyasi’s wife Anju committed suicide on January 10, 2000 in Delhi. While his mother–in-law, Rukma Singh wanted custody of the child on the ground that she had the right under Muslim law, Ilyasi had taken the plea that his marriage with Anju was not solemnized as per the Muslim law but had been a civil affair. His sister-in-law Rashmi Singh came from Canada after six months of her sister’s death and filed a complaint with the police against Ilyasi, alleging that he used to torture his wife Anju for dowry.
The case took bizarre turn when Anju’s brother Prashant Singh and father Prof K P Singh took a diametrically opposite stand and described the allegations against Ilyasi as “rubbish.” Prashant told Express Newsline:`whatever my mother and sister Rashmi are stating against Suhaib Ilyasi is a lot of rubbish. There is no truth in their statement or in the charges filed by the police against Suhaib. If you are holding Suhaib responsible for Anju’s suicide, then my mother and sister are also to blame, as they unduly interfered in their family matters.
K P Singh, a retired IIT professor, agreed with Prashant. “My wife and daughter are breaking up my family”. Both Anju’s father and brother allege that Rukma and Rashmi have given statements against Suhaib as `they wanted custody of baby Aaliya. When Ilyasi delayed that, they put him in trouble.’
Anju’s mother Rukma Singh had changed her earlier statement given in January, 2000, in which she had stated that she did not suspect any foul play by Suhaib Ilyasi. However when Ilyasi refused to give custody of his daughter, she change her statement and alleged dowry harassment against Ilyasi.
It has been alleged for long that Dowry Act (498a) in India is being consistently misused by clever women for extortion and blackmailing. The NCRB records suggest that during 2005-2006, 94% of the 498A, 304B cases filed by women or by her relatives were primarily to settle scores.
Section 498A in itself is, however, not meant to deal specifically with dowry — it is commonly considered to be a ‘dowry law’ because domestic violence against a wife related to dowry demands is considered to be within the scope of ‘cruelty’ envisaged by the Section.
