Sanjay Dutt New Delhi, Apr 14 (ANI): Bye-election to a Maharashtra legislative council seat will be held on May 5, paving the way for Chief Minister Prithviraj Chavan to get elected to the legislature.

He is at present not member of assembly though he assumed charge on November 11. The Election Commission said that notification for the by-election would be issued April 18.

The last date for filing nominations is April 25, and the scrutiny will be conducted April 26. The last date for withdrawal of candidature is April 28.

The entire process will be completed by May 7.

The seat fell vacant after Sanjay Dutt of the Congress resigned on March 11 to facilitate Chavan’s election.

Meanwhile, the Election Commission had decided to send the Chief Electoral Officer of Maharashtra as Commission’s Special Observer for the fifth and sixth phases of Elections in West Bengal in view of his experience of conducting elections in the extremist affected areas of Maharashtra, with directions to report at West Mednipore on May 5 positively.

In the elections by Members of the Legislative Assembly, the Chief Electoral Officer is made as the Observer of the Commission. As such it would not be possible for him to act as Observer for the poll on May 5 and subsequent counting of votes on the same day in the said bye-election to the Maharashtra Legislative Council.

The Commission has accordingly decided to advance the date of poll in the said bye-election to May 4. (ANI)
