Government accepts recommendation of one-rank-one pension for ex-servicemen

Pranab Mukherjee New Delhi, July 6 (ANI): Finance Minister Pranab Mukherjee on Monday said that the Government has decided to substantially improve the pension of pre 01.01.2006 defence pensioners below officer rank and bring pre 10.10.1997 pensioners on par with post 10.10.1997 pensioners.

Presenting the Budget proposals for the year 2009-10 in Lok Sabha, Mukherjee said that it was based on the recommendation of the Committee headed by the Cabinet Secretary on One Rank One Pension (OROP).

The Minister further said that these decisions will be implemented from July 1, 2009 and will cost the exchequer more than Rs. 2100 crore annually.

“These measures will benefit more than 12 lakh Jawans and JCOs. Certain pension benefits being extended to war wounded and other disabled pensioners are also being liberalized,” he added.

Under the one-rank one-pension scheme, a retired defence personnel of a particular rank would be entitled to same amount of pension irrespective of the year of retirement. (ANI)

    Govt has just made a mockery of retired defence officers. Pm and FM think that defence officers belong to elite class and are Khandani Rayees and do not require any monetory help. My dear PM and FM saheb please think over it again. Ask yourself that have you done justice to officers. I am doubtful that you may ditch PBOR also as no final orders have been issued,.

    In the budget speech, the FM declares based on the recommendations of the committee, says that pre 97 pensioners be brought in par with the year post - 1997 pensioners, these words are slightly confusing. One rank one pension means pension be given to all as per the 2006 pension recommendations.

    Nothing spoke about the 70 perecent weightage which was approved by the cabinet earlier. pl pay these soldiers immediately. Everybody is waiting for it.
    The serving soldiers make up their mind on the baisis of what their pensioner friends receiving from the govt. thank you sir.

    This is former iaf member gp-1 jwo wef 30 nov 97, all these changes are for gp 2 and below rankers, gp-1 members forget any changes in ur pensions, it is just an eye wash, a hindi saying (Gadha-Godah eik), all ur efforts of keeping airforce hi-tech equipments sky worthy in gp-1 position were only for that period and today ur are back with gp-4 or gp-5.

    Officers led our troops to victory then they led them (after retirement ) to victory for ONE RANK ONE PENSION. They were punished for this act. Kya chaal kheli hai govt ne officer or jco/jawano ko bantne me. Mubarak ho PM, FM and DM saheb

    The govt announced the one rank one pension in the parliament. Nothing heard so far from the pension authorities. Really how much benefit the old pensioners be getting?secondly what about the 70 percent weightage to pension to serving and retired solders. I am told that still the soldiers going on pension are not being granted the 70 percent benefit. The cabinet approved this benefit before the election, once the UPA came in to power, they keep mum.The leaders of the exservicemen and the serving soldiers must speak to the govt, please circulate the real story for the information of all concerned.It is heard that the General of the army also not speaking about this problem to the authorities.Unless you strike, the civil babus never act. Please give a feed back.Thanks

    Hello their!

    I am an ex-serviceman retired from Indian defense force on 30th June`1996 as PBOR (JCO)after completing 20 years of active service. I joined a central government organization on 08th Oct`1996 as re-employed ex-serviceman. My pay was fixed on maximum of pay scale giving benefit of my previous defense service by adding 19 yearly increments and by deducting my entire pension (Basic pay minus pension). I am not getting dearness allowance with my pension. I am drawing my pension directly for public sector bank.

    2. I request any body who can give me advise whether my above-mentioned pay is fixed properly if not than the corrective steps I have to take. whether I am entitled to get dearness allowance with my pension? I also came to know that recommendations of fifth pay commission were implemented w.e.f Oct`1997. Some pay scales were enhanced w.e.f Oct`1997. Person like me who retired prior to oct`1997 were not given benefit of enhanced pay scales. I also came to know their were lot many case in the court of low for remedial.

    3. Now the government of India has implemented sixth pay commission’s recommendations. Any one who can send me the complete details affecting pension of ex-servicemen and their re-employment. Government also recently announced one rank on pay for ex-serviceman. Please send me details of the same. (full details along with copies of authority letters)

    If u r drawing pension from SBI u get ur pension but do not know how much is basic, da or arrear. On every change pay slip must be issued to individual pensioneer or at least to the bank from where the pensioner is drawing his pension.

    OROP why only to defence persons,what sin civilians have done.If Defence personels are thinking that they are the only gaurdian of this country.It is wrong thing going on in this country .They and their high ups are behaving like trade union leaders,govt. should immediately break up this practice.By this time they have sqeezed enough of taxpayers.They are pressing one demand after other.In fact they are immensely benifited through free ration,,traveling,taxfree commodities through canteen etc.Defence persons working in remote area are getting other allowances still they are demanding more and more. In fact there are many caders are working like civilians and there nature of job is also civil but they also want to extract the same benifit only on the name of working in defence organisations.Enogh is enogh Govt. should stop this pulling by them immediately.and also consider the civilians for OROP if defence persons doing civilian job are considered for the same.Because there is avast difference in pension drawn before and after oi-oi-2006.

    Poor sudharkarji never knows about the military personnel ie about their duties , responsibilities, hardships they face while serving for the nation. Probably sudharkarji may be a civilian employeee, may be with a state govt or with the centre.Civilians work and live in their own style and without any pressure or compulsion. See around civil govt complexes; how much output a civilian employ has to produce; how sharp has one military man to stay, how carefully he has to stay;how much discipline he has to maintain; he is sacrificing his easy life unlike his civilian friends; thru how much odds he has to move. Sudharkarji, by luck, a civilian gets into service once -means, he stays back up to 60 without any fear, whereas a military man is being thrown out of srvice in his younger life, with a megre pension; by that time his reponsibilities will be completed only one-fourth; and that poor defence man has to go for all types odd jobs to run his family. Sudharkarji, is it the case of a civilian employ, probably you are sitting in a cage without knowing what is out side. what is the importance of military force for a nation and its people.
    All nations are s triving for strong defence whereby their survical is ensured, in that scenario your comments are rearly suicidal. Correct it man for the national sake.

    My Dear Kurupji you have not understand the thim of my cmments properly.You got angry on my comments because you feel it is direct encroachment on your asking benifits.I am well aware of the hardships the defence personels are facing,but at the sametime donot under estimate the burden and tension has to be bear by civilian staff also.In defence services also one catagory is no better than the civilians.My dear friend I am not siting in cage and I have much more exposure than you,my coments were well thought.In fact you defence personels are siting in the cage and have limited thinkig.So please donot prolong further coments after coments think realistic.Do you think that a Nurse working in civil Hospital has less responsibility than a Nurse working in Military Hospital.Why she should not demand for OROP.

    My intension was not to hurt you but to make you feel that if such language is used for you then how you feel. There are bad politicians who bring bad name to the country but ther are very good politicians also who have made India prous of it’s progress. Similarly ther are well experienced and highly disciplined officers who have taken forces to such a greight height. These are the officers who gave led Indians forces to Victory in 65 and 71.
    You might have been victim of some officer due to his bad deeds or your own bad discipline. That is why you are using filthy language against them. Don’t do it as it reflects your social and mental standard. The govt is not giving us our dues but we have to protest with our full united strength but in a civilized manner. Govt is not giving proper treatment to PBORS and Officers. Because senior officers are leading them in the protests, the govt is trying to create an ocean of difference between officers and PBRS. Mind it without their guidance proper treatment to all ranks is not possible.

    You asked about me. Well I joined Army at an age of 14.5 yrs. After serving as OR for 10 yrs, I was commissioned as JCO. After another 13 yrs in JCO rank I got commissioned as an officer and after further 14 years I retired as Major. As an OR I took active part in 62 and 65 wars in J&K. As JCO I was in action in bangle Desh and as an officer I spent 2 years in Sri Lanka fighting LTTE.

    Now join the ex servicemen to fight against the wrong policies of Govt towards all of us.

    As far as I knows yes, they are counted as officer in case you want to utilize CSD facility or apply for reemployment or self employment. But as far as pension is concerned they are PBORs. Hence Hony Offrs must benefit from One Rank One Pension. We will clarify further as I may be wrong.

    Dear my Ex-Service Brothers,

    Rather than fighting each other among officers and PBORs, try to find some solutions to get OROP implemented at the earliest. If possible, advice officers category personnel not to interupt the implementation by equalising every one just for want of benefits extended to PBORs. They can fight for their rights and get the benefits as most of the senior officers having political contacts of various parties.

    I just gathered that 70 percent weightage is not allowed by the govt, I have no confirmation. Pl find out from your sources as well.We can get this information thru an RTI. Since the exservicemen were drawing pension thru the 70 percent weightage, how this pay commission can take out this benefit. If any knowledgable person reads this, pl advise us the legal side of it. I think the exservicemen were enjoing the pension on the 70 percent weightage, I dont think such benefits can be taken away from them in a fine morning; infact something can be added. Please get some information and comment. If this is the case , surely we have to go to the court.

    Thank you for your comments stating that top priority must be given to PBORs. At the same time, kindly pass on your acceptance to http://www.IESM.org (in my opinion it is a website which speaks so many things about equivalisation). If you compare the benefits and preferences between Off & PBORs, difference is a lot. But we should stand united to fight. When it comes clearly that officers are opposing implementation of OROP to PBORs for want of same to them, we can not say it is unity. Advise and ask them to get OROP implemented first and fight quotingand demanding the same for them.
    I would like to know the procedure to apply for RTI.

    70% and then OROP. Our hounerable PM and FM and DM are constructing a Mirage around us. More we go deep more we find nothing. Govt never accepted OROP but cleverly announced that our pensions will be increased. “How much and when” no body knows not even the govt. have a patience and wait, may be, for years.

Many senior officers are there who have close contact with all level politicians, they all can use their influence to get OROP for lower deck personnel(In Naval Term).     Regarding one rank pension, I am learning from the leaders of exservicemen that the govt is not accepting the demand of one rank one pension. What precisely I understand is that the exserviceman leadership is not very anxious to do it. Sir thru this blog why dont u call the exserviceman associations of various states and arrange a meeting in Delhi and take some steps to do some thing in this regard.Incase you take some initiative and do some thing. comeout with your opinions and write to pm on blog , it is not something will comeout.write to me on this site. sitting idle means nothing will happend. The present leadership is not pursuing the matter.every will propagate this message to various states. There are many hidden problems.

    it is because we do not form a decisive vote bank. Even if all of us vote against ruling party we wont be able to defeat them. Our presint Chiefs can do some thing. We must reqyuest them to come to our aid.Firstly Govt tried to isolate retired officers by declaring that One Rank One Pension will be given to PBORs and not Officers. We welcome it and request that Govt must stand by it’s words. But no, they have ditched PBORs, as expected. It is a shame for them. Yes we are always at receiving end. Next time do not vote for them.

    After blaming the govt, sitting mum is not the answer, we re-organise our exservicemen group. must inform the state units and must hold a meeting in Delhi and take the help of the MPs of all political parties, The govt can solve the problems of all, but not the exservicemen. Why dont our leaders sent an open call explaining the stand of the IAS cadre in ditching the exservicemen. Since u have a blog and must be aware of the developments, please jump into some action. sitting idle means legs get paralised, similarly ours also.     As all are aware that ex-servicemen League, TEXCO, DSSAB and so many organisations are formed on the name of ex-servicemen in District, State and National Level. But there is no one to motivate ESMs to get united and fight for the rights. Untill We throng Delhi by gathering at least 50% of ESMs to get our benefit we won’t be able to get anything from the Govt. So what is my request is that Please write to all such organisations of ESMs to motivate those come under their union/organisation to arrange an assembling atleast in District level first. So that the Govt. will definitely turn towards us. Kindly do this to achieve some result.

At your end, write to authoirities known and listen to you to organise a gathering immaterial of the political party concerned. Frequent writing may change their “View”. Please try to spare your valuable time to find email or postal addresses of such organisations and encourage them to gather the members at their district level to make them aware of gathering to get benefits for through out our life. If not 100% atleast 30 - 50% will turn up.

    After reading various comments posted by many of my friends, it is seen that there is a big frustration on everyone’s mind. There is no point in scolding someone. I dont think it takes more time for a person to rate this country. This is disguised nation. Here the rich, powerful and mighty people can only survive. Because these category people can get away easily after committing grave crimes. Whereas look at other countries. So there is no point is wasting your energy. Moreover, the so called Officers of the Armed Forces think that there are the most genious people. Whereas I am sure having seen the civil counterpart, these Officers cannot survive even a single day. There is a huge difference between an IAS and a Defence Officer. An IAS commands an in-discplined force where you will find people are not literate/educated also. Whereas the Military Officer is commanding an discipline force. So there is nothing big with these Officers. They are very smart in shouting at their sub-ordinate. Whereas they cannot even say a word to a civilian who is working under him in many of the Defence Establishments. So wait for the bureacrates to take their own decision. Finally very few Officers and below Officers rank people know about the current activities and civil societies.

    Dear frnds and especially Mr.VRKC Nair. The discussion is not about the capabilities or negative points about Army officers, we do not want any comparison with IAS. Our discussion is that we are being cheated by our govt. yes our officers, the high brass, is partially to be blamed. These are very sr officers who are policy mskers. ther were officers of Lt Gen rank sitting on hunger strike for OROP. Govt tried to seperate them from PBORs by declaring that only PBORs will be given or may be given OROP. I do not know how far govt sucseeded in doing so. But definitly govt has cheated PBORs. As officers we are with the PBORs. Govt must give OROP to PBORs. We welcome this. We will try our struggle for officers later on.During service you might have suffered in the hands of officer due to hardfship of service, wrong decision by some officer or of course your own indiscipline. But thie is no time to argue. We all are ex servicemen now and we are totally powerless. One of our dear friends has called officers “Bastards”. I pray to God that his son must get commission into defense forces than will he call him the same name? No, we are showing our mental instability , loss of our thinking power or our “IQ” by saying so. Our discussion is about ill treatment towards ex servicemen. If you want to analyse, praise or abuse officers then please start a new blog for that.

    I am told that it was told in the District level gathering of Ex-servicemen at Paramakudi in Tamil Nadu that OROP orders have been finalised and draft orders sent to Defence Service Headquarters. But no comments have yet been posted by the Three Chiefs since there is no mention about officers entitlement for OROP. And further, some ex-Air Force personnel filed petition in Court seeking effective date for OROP with effect from 01 Jan 2006, I would like to know whether it is true?. And if it is true what being done is not fair. Beacuse no one can agree that all are same after quitting service as you said. I would like to ask only one question would any officer category person like to stand in queue with JCO’s and OR’s in Canteen. They want a separate line, previlege, entitlement, ceiling and every thing almost equal with what they enjoyed whilst in service. These sort of activities are iritating PBORs even after retirement also. So I would like to request all Off category personnel not to interfere in implementation of OROP to PBORs. You can very well fight for you quoting this after implementation.

    We can understand your feelings. Our chiefs are busy in their day to day activities and facing new challenges. They have already approved, Now this issue (orop) is in the basket of Govt of India, Finance ministry. I’m also belong to OR community. At least try to understand the limitations of Officers. Even they are also facing problems at their level after retirement like us. Difference between us and Offices is only facilities. They are here to help us if required from their end. Please don’t think that they are against to us. gone are days when we are in service there have been cold war kind of thing between us. It’s time for us to seriously look at Govt when they are implementing the OROP.

    now regarding OROP– lot of misguiding is t5here. If it is decided, next day all papers will be full of this news, So nothing has been decided or revealed. The chiefs have nothing to do with it.

    Some of our friends have put up a point6 that retired officers must stand in the Q in canteens. Tomorrow all civ retired people will ask for the CSD facilities as they are also central govt retirees. This is not fare. I have got a lot of retired frnds here. Some of them are sepoys, ncos and jcos. They are senior to mne in age and so I always greet them first give them full respectin socity. But in Canteen I use my facility. When I paid Rs 18000/- for ECHS no body said officers must pay less. Officer or PBOR, we belong to the same economical socity. Almost all PBORs in my area are having property worth crores against my worth few lakhs, but as an officer I am an officer and do guide them whenever required. Let us not drift away on minor points. We must fight for our rights that is OROP for PBORS as well as Officers.

    We as nation of India do not want to give OROP to our troops. If it is possible to deny this then we must deny and save a lot of money which would be unnecessarily going to ex servicemen. It has been observes that very senior officers are guiding ex servicemen for their fight for OROP. So two steps have been taken:

    1. Declare something sounding like OROP to PBOR. This would make PBORS happy and the guidance by these senior officers would not trouble government.

    Now once the senior officers have been separated from PBOR and the gap widens, do not give any thing to PBORs as nothing had been promised to them.

    My dear friends the govt has succeeded. To shut up your mouth some thing (not OROP) will be given to you as lollipop and without guidance of our very senior officers, the war heroes our brave PBORs will be able to do nothing.

    So wake up. IT IS NOW OR NEVER. Without the guidance of these very senior officers we would be able to do nothing. Do you think that War is won without planning of superior officers?

Supreme court heavily slap on the government that “dont treat soldiers like beggers” yesterday.So some high instituiton is there tolook after our case.Asper Article 145 of Indian constitution we had the right to ask OROP which cannot be denied by any government.The fact is same OROP have been given in Kerala, Punjab and some other states where the central govt is not all interested to implement it. But OROP for President ,PM and cabinet and state ministers, MPS oflok sabha and rajya sabha, judges, and indian administrative services have all been impleted wherein there was no any administravie difficulties or financial constraint to the government.If things are going like , then one day our forces will be under ambanis and etc.Indian national congress not INC italian national congress wantys to demoral;ise our soldiers, so that any country could invade our country. we should resist it firmly or otherwise will be again slaves .

    I am try to translate the news in Malayala Manorama in regard to courts verdict and findings.There was one CS Sisdhu an SSC offr who join the army during 1968 and his right hand was amputated during 1970 and he was discharged during 1978. MOD has sanctioned Rs 1000/pm as pension to the opffr. the offr plead the govt to raise his pension but it was rejected. Then he appeal to the High court of haryana and punjab wherein full pension has been ordered by the court. then the central govt file a SLP with supreme court.The finding of the court as under quote.One begger could get rs one thousand if he beg anywhere in Delhi. But you (the govt) give only rs one thousand who lost his one hand while guard the nation.It is most un tolerble as we other than the forces live in peace only they guard us, our property, our land. unquote

    If a person goes to any part of Delhi and sits for begging, he will earn rs 1000 everyday and you are offeringa pittance of rs 1000 per month for a man who fought for the country in the high altitude and whose arm was amuputated.
    Is this way you treat those brave army offrs, It is unfortunate that you are treating them like beggers a bench of Justice Markandeya Katjy and AK Patnaik said in verbal comments while passing the order.
    The army personnel are bravely defending the country even at the cost of their lives and they should be treated in a better and more humane manner by the govt auth, particularly in respect of their emoluments, pension and other benefits, the bench said in order.

    Now another attempt by the govt. recently some hrs before veerappamoily send back the namesof judges who were recommended to be senior judges by the supreme court coolegeum.bcas they want their own men in the courts.
    However there are someone in the courts who will look after the article 14 and upheld the constitution. As AFT chandigarh has ordered to issue OROP in two cases, the govt will have to file SLP withsupre court. time will be taken but we hope in the courts.

    I want to bring to notice thru u some parity in pension even after implementation of OROP. As per circular No 430 dt 10.3.10 basic pension of subedar with 28 years pre 2006 retirees has been fixed as Rs 11970/pm whereas my pension has been fixed as Rs 9755/- pm I have been retired on 30 Jun 2006 in the rank of subedar with 28 year of service. Apart from my pension, as far as my calculation and idea is concerned no subedar, except X Gp and directed entry JCO, will get basic pension equal to or more than 11970/-pm. Is something is being done by the government on this issue or post 2006 pensioners will have to approach to court.

In J&K, Assam, Manipur- each day our uniform men are dying, okay few claps, cheers and award for few and that is it. Had we’ve been united, Moghuls would not have entered India neither English. We were the leader of this world, had everything till 1720. We were world leader and today we are in shambles, and more so our corrupt netas, lawmakers are further degrading us. There convoy drives through the bumpy road, disfigured path but they never take any heed. I hope they have eyes and brain to see but they see the money which will follow on order of road building project, which happens in paperwork, hardly in reality. They are sending staggering amount to Swiss Banks and feeding the Swiss with interest of our common Bhariya money, Swiss per capita income is about USD 55000. Our neta so crippled that they talk big but can;t get this public money back to India. No one will be poor if this money comes back. Who will do that? I think Baba Ramdev has a point- Swabhimaan Bhaarat. 3 months fast track court and hang the corrupt person till death. So folks…it is time to think about yourself while support the OROP movement, but please do no rely on it and find, create or do something to benefit your life and your family.
    I must tell you that I retired after 15 years of meritorious service in the Nausena. In service I completed BA, 2 years before retirement. I started hunting for job opportunities, result-the very next day I retired, I was working in Dubai as diver. I hunted for better options and I became Security Officer in cruise lines. Here I completed M.Sc and at age 49years, I am pursuing Ph.d. and presently working in Carnival Cruise Lines as a Senior Officer drawing a salary of over 5 lacs per month. The message I want to send to all my colleagues and Jawans that education matters and effort with result mattters. Support the OROP movement BUT do not rely and wait for it. Help yourself, look for opportunity or develop your own work space. Therefore, it does not matter one was officer in Defence, yes that is good, but PBOR’s can be officer after retirement and shape the future. The time has to be right of making decision. So all of you, as your age has surpassed the hiring age. I can help your children to get into Cruise Lines. They should be graduate, Good English (speaking, reading, writing and understanding)-I can guide them to join as Security Officers. As Cruise lines is a hospitality industry, direct managment level is hard to crack. The easiest way is to get in as Security Officer/Guard and than rise from there once they are in. Salary of Security Officer/Guard is between USD 1300 to USD 1000. Food & Accommodation free. 6 months renewable, performance based contract, two way air ticket free. See the world. I want to say that let us create job or guide our colleague jawans sons and daughters to the job which can change their future. What is respect of military men, I learnt that in USA. With my Ex- Servicemen Identity Card, I am greatly respected here in USA when ever my identity is asked, I produce Passport and Ex-Servicemen ID- its a great feeling when American authorities pay respect for the military service done. I wish in India it would happen. So cheers to all, be positive, optimistic as life goes on, bring change to your life by thinking beyond OROP, once approved you will get it.     “The factual position is that we have constituted a committee under the cabinet secretary to look in into issue of one-man-one-pension and other related matters. The committee did not recommend one-man-one-rank-pension,” Manmohan Singh said in the Lok Sabha.
    The prime minister’s remarks came after Bharatiya Janata Party (BJP) leader L.K. Advani accused him of breaching parliamentary propriety by making “false” claims over the scheme.
    “But whatever recommendations the committee made to substantiate and enhance the pensionary benefits of persons below officer rank and commissioned officers were accepted by the government. This is what I have stated in my Independence Day speech,” Manmohan Singh added.
    The prime minister said of the seven recommendations the committee made, five have been implemented while the other two will be done soon.
    “Advani informed BJP MPs about PM’s claim in Lok Sabha that the government had implemented its decision on enhancement of pension to JCOs (junior commissioned officers) and jawans (soldiers). No JCO or jawan has received any such order. This is a very serious matter of parliamentary impropriety,” BJP leader M. Venkaiah Naidu said Thursday quoting Advani.

    Major Saini, I am looking forward to help the grown up children of officers, JCO’s and Jawan to join in Cruise Lines. So far I have placed over 60 Boys and 04 girls in Cruise lines, NO FEE, all Free as this is one service I can offer to all men in uniform- my brothers.     As per hARYANA AND punjab high court verdict, the asnomalies would have removed from the date when it was occured, i,e, 1st oct 97. as per coas recommendation, this has not been effected. simply they upgrade the pension then increase it as per COM , even not effect from 01 jan 2006 but from 1st jul 2009. I would like to know , that this is not a breach of court order.

Wherever you are working these days, if there is any opening, advise Mr. Kumar so that he feels that he is not left alone.     Later on I passed degree in electronics and telecommunication engineering,somewhere in june 1986.I was recommended for commisioning in technical branch of IAF in nov.1986,by no.1 SSB Dehradune.But the most intelligent doctors at AFCME NEW DELHI and Army Hospital Delhi Cantt,intentionally made me unfit for commisioning in tech. branch of IAF .They have ruined the career of many deserving pbors .Anyhow I COMPLETED my eate15 years and left IAF.
    I would like to advise my ex-servicemen brothers,especially those who left at young age ,not to waste time on orop issues and instead of that concentrate on your present career. There is no dearth of opportunities outside the defence milieu.ONE must have positive attitude,perseverance and will power.Please don’t waste time on recllection of our past history.Let us move ahead and come out of this close room and sit at the roof top where we can see the clear sky and fix our goals .You can’t depend upon your meagre pension to survive in this competitive world.

    AFT chandigargh ordered to pay OROP to all officers and men vide their order of march 2010. What is the present position of decision. 4 months passed, The cabinet secretary got extension and extension. he could manage everything at the cost of other IAS officers who were about to be promted, once the present CS is gone on pension. Those IAS offiers and exservicemen may be cusrsing him for this inexplicable sin which may be passed on to generations together.Any how the exservicemen organisations may advise us what is the present position of the OROP.What a sinnful birth this CS got. God will not forgive him.I have seen many poor old persons, widows and chidren helplessly cursing him for his noncooperation towards the ESM.He is sinkinng himself and the UPA.Now the poitical leadership shoud avoid this gentleman

    I just read the last recommendations made by the CS and his team denying the OROP. He very cleverly argued not to grant OROP and that was not a case of judicious arguements/recommendations. The serving personnel are aso very unhappy on the decision of the govt not to agree to the OROP. The CS took clever steps to devide the officers and men by granting some relief to PBORS. NO, the defence force is one rpt ONE no, difference of opinion between officers and men. I am from PBOR, I spoke to many people, everybody agrees to this point.Sir, organise ourselves as one team to have our purpose of life achieved.

    Dear Friends,

    1. The gross injustice, apathy negative attitude and indifference of the Govt and the bureaucracy have crossed all levels of tolerance and acceptance. There are two options, one, to accept the status quo, live the life as it unfolds and melt away. The second option is to get up and fight for Justice. As a soldier, the have learnt to follow the second option.

    2. I wish to quote a few instances of Govt apathy and injustices:-

    (a) All Party parliamentary Committee is supposed to be one of the most powerful committee. This committee headed by a congress MP Shri Satpal Ji Maharaj while tabling its report in the Parliament on 07 May 2010 had recommended the grant of OROP to the Defence Personnel. Three months have passed, the Govt has not taken the decision on this recommendation. Why the Govt has kept this committee report under the carpet is not understood? This was the chance before the Govt to undo the damage already inflicted on Defence Forces.

    (b) The Govt has not implemented any of the judgements recently passed favouring the Defence Personnel:-

    (i) SC judgement in Rank Pay case. Instead of accepting its fault and implementing the judgement, it has appealed to the SC to recall its orders.

    (ii) In the case of pre 96 Maj Gens (Maj Gen Vains Vs Union of India), the Govt continues to ignore the implementation of judgement fully. Instead of giving the same pensions to similarly placed pre 96 Maj Gen as per Para 31 of the SC judgement, it has fixed arbitrarily the pension of pre 96 Maj Gen by increasing it by Rs 500 pm ie Rs 10000/-instead of Rs 11450 being given to similarly placed post 96 Maj Gens.

    (iii) In the case of Pre 2006 Maj Gen, the Govt has not implemented the judgement of AFT Chandigarh dated 03 Mar 2010 where in the Govt was to implement the judgement within 3 months. The execution proceedings have been filed by the Maj Gens and the hearing is on the 10 Aug 2010.

    (iv) In the case of Babu Ram Dhiman and Sohan Singh Vs Union of India, AFT Chandigarh judgement on OROP dated 08 Mar 2010 which was to be implemented within 4 months, has not been implemented.

    (c) The widows of JCOs and Jawans who need the maximum assistance, care and compassion have been left out from the recent enhancement in pension of JCOs and Jawans. Here, also instead of giving the enhancement with effect from 01 Jan 2006, it has been sanctioned with effect from 01 Jul 2009.

    (d) The 6th Pay Commission had granted three Assured Career Progressions (ACP). Strangely the ACP has not been applied notionally while fixing the pensions of Pre 01 Jan 2006 retirees. Even for Post 01 Jan 2006 retiree defence personnel, only two ACPs have been granted. Why the third has not been granted to a Sepoy who has been compulsorily retired from service after 17 years of service?

    (e) There is a large gap of Rs 11600 in pension of pre 2006 retiree Maj and Lt Col while the gap in their pay in the 5th Pay Commission was only Rs 1000/-. Similarly the pension gap between pre 2006 retiree Maj Gen and Lt Gen is Rs 9800/- while the difference in their pay prior to 2006 was only Rs 1200. Why this grave injustice?

    (f) The President has not granted the audience to the delegation of IESM depositing medals with the President.

    3. The Govt indifferent attitude has irked the veterans severely who have decided to intensify the stir. The next event for deposit of medals and submission of Blood Signed Memorandum to the Supreme Commander will be held on 22 Aug 2010 at Jantar Mantar New Delhi from 11 AM to 2 PM. IESM delegation will leave for Rashtrapati Bhawan at 2.15 PM to deposit the medals and memorandum at 3 PM to the President. Chairman IESM Gen Raj Kadyan has written to the President quote “It is earnestly hoped that the Supreme Commander would relent and receive the delegation in person. However, should that unfortunately not happen, as already intimated vide ibid letter dated 08 June 2010, the delegation would return without depositing the medals and the memorandum” unquote

    4. All conveners are requested to put in their best effort to motivate the ESM across the country to deposit their medals and sign /thumb impression the memorandum in Blood voluntarily for the above event. We hope that in the country specially the Northern States where large number of ESM reside are able to reach the target of 5000 Blood Signatures and medals each district. These can either be sent to IESM HQ at 543 Sector 23 Gurgaon (Hr).- 122017 or brought to Jantar mantar on 22 Aug 2010 by 11 AM. Conveners are requested to get maximum ESM at Jantar Mantar. Part payment of transport charges will be made from the IESM funds, Tea, water and lunch packets are being arranged for the ESM attending the event.

    5. Logistic Instructions for the event will be issued by the General Secretary separately.

    6. We are also, putting efforts to get support from all segments of society including all political parties, MPs, MLAs, CMs.

    7. Please circulate this mail to maximum ESM across the country.

    i am retired from indian army as hony lieutanent in active service and after retirement i got hony capt after completion of 31 years of service as a subedar major.Now the policy of the indian army that subedar who had completed 28 years of service also got the same hony lieutanant rank.In the rank subedar major one has to serve 4 years complusary, that to subedar major rank also awarded after tuff comptetion, now subedar and subedar major awarded same hony lt rank after retire ment, i mean to say that there should be some different between subedar and subedar major in the rank structure. Subedar major is highest rank in pbor and after retirement both ranks are awarded with same hony rank.My request is award the hony ranks to both of them like subedar as hony lt and subedar major as hony capt with pay and allowances after retirement.Some cases i found that subedar retired on 26th jan got hony lt rank and served up to 15 august will get hony capt in active service and became more financial benificer than subedar major. pl rectify this type of irregularties and treat them in different hony ranks after retirement . when one is getting same facilities by serving less, is it necessasary to serve four years more?

The corrupt political leaders, sitting in parliament, are passing their pay bills unanimously irrespective of their party disputes on all other legal/illegal matters whatsoever they may be. But they keep mum on the very legal demands of the patriot soldiers and saviors of the country. In fact they are getting richer and richer by pleading against the fighting forces.

    I have gone trough all the comments and shocked to learn that we are fighting ourselves. I think you are doing some novel work for ex servicemen. I I have worked in Indian Navy for 10 years from 1976 to 1986 as a sailor. I didn’t like the atmosphere and the naval culture so I left the service. I would like to raise one point. If one MP is getting pension, medical benefits etc after only 5 years of service then why not other government servants? Can’t we fight for the same? Do you know India is the only country where MP’s are fixing up their own salaries? I think this is the proper definition of democracy. In the conclusion I would like to say I LOVE INDIA and if required they can call me to fight again.

    I am a Ex-Serviceman from Navy retired as JCO .With out military , There is no security at all in the world especially in India.All terrorist groups are around the corners of India and both Nation Pakistan and China are looking to attack India by means of any wings.The person who served the nation will know only how much struggle in his life he got and How he managed himself to grow in the world with his family.Almost all employees in the civil and and political know how to make money during his service .either doing his own business illegally or taking bribes from others. But in military only his salary give him to enjoy his family and some mere benefits.Suppose he die in the younger age ,everything is lost .During his tenure in his military life ,how much he has to work hard with disciplined manner.he does not allow to have any freedom in his life. I became as civilian now .I enjoy the freedom now but i have proud to be served for the nation also.Kindly do not abuse either serviceman or ex serviceman and encourage them to keep our nation strong and be proud of an Indian .Think all are protected by them and salute them for their brave duties and responsibilities like in the olden days Raja and their troops are known as their GOD.Even you are protecting your properties by making fence for your self .Some one break ,How much you feel.     Here the question is? Does anybody care ?? Supreme Court does not seem to understand perhaps that the reprort will be given to him by DS an IAS who has zero understanding of Defense Forces capabilities and operation. In 10 days what he will understand is what one or two offiers will tell him. This is absurd. No grudge agaist officers but freedom of speech should be availed. All rank meeting should be conducted and checked with those people who are doing the actual duties for long time. DS should dwell with them for 3 months and follow all duty schedule. No one wants to take the pain. Who are the netas who have never served in defense forces and they decide our fate. The defense team should involve all defense persons representative at all level with accountability and their recommendation should be honored. Why our top brass reccommend junk ship Gorshkov as Aircraft Carrier, Old Ship from US and other countries, we have man power, expertise and shipyard, spend the same amount here and make indegenous model ships. aircraft and weapons. I heard that most of the amount from defense budget ovelaps or is returned to government. I do not know if that is true. If it is than it is shame that top brass want to show the saving in budget by crushing the better war equipment options and pushing All ranks in cliff wiht no heart or mind to mourn for. It is misery of our nation. First Moghuls ruled and massacred us because we were not united-CAST SYSTEM or REGION etc. Than British. What more to say NOW by our own people. We can continue writing for ages no bell rings up there. We should think how this can be changed or how such change can be brought to the sytem. At least our future generation will uphold thier heads and not malign or involve in worsening the present situation. When a child is born - child does not know what is cast-what is religion-what is corruption-what is terrorism - hatred. It understand the language of Love. When this child grows up than Where this MARVEL thought dissappear? Let us clean ourselves from home and usher all to do so, do what we can to convince them, may be we will see a better India in next decade. A thought….

    ONE RANK – ONE PENSION (OROP)

    1. The Ex-Servicemen (ESM) are amazed at the reply given by the Defence Minister in parliament the other day that granting of One Rank One Pension was not possible due to financial, legal and administrative reasons. The financial burden is too inconsequential and legal reasons have been adequately set aside by the courts in many of its recent judgements. As for as the administrative reasons are concerned, this is due to the mental block of the bureaucracy and its agonistic attitude towards the Defence Forces. That such a statement should be made by Defence Minister of India, in Parliament inspite of various SC, HC and AFT judgements to the contrary shows the scant regard the Govt in general and the Defence Ministry in particular has for the judiciary and morale of the Defence Forces. Some of the recent judgements are listed below:-

    (a) SC Judgement of 09 Sep 2009 in the case of Union of India &
    Maj Gen Vains and Others. The SC ruled that:-

    (i) No Defence Personal Senior in rank can get less pension than his junior irrespective of the date of retirement.

    (ii) Similarly placed Officers of the same rank are to be given the same pension irrespective of the date of retirement.

    (b) AFT Chandigarh Judgement dated 03 Mar 2010. In the case of union of India and Maj Gen Vains and Others. The AFT ruled that the SC ruling in the case of Maj Gen Vains and others Vs Union of India dated 09 Sep 2009 be applied to the Petitioners for pre 2006 and post 2006 retirees and the judgement be implemented in three months.

    (c) AFT Chandigarh Judgement dated 08 Mar 2010 in the case of Union of India Vs Babu Ram Dhiman and Union of India Vs Sohan Singh The AFT has directed the Union Government:-

    (i) That the state cannot lay down different criteria for grant of pensions to officers, JCOs and Jawans on the basis of cut off date of retirement.

    (ii) No Senior in rank defence person can draw less pension than his junior irrespective of the date of retirement.

    (iii) All pensioners of the same rank and service irrespective of the date of retirement are entitled to same pension.

    (iv) The above directions be implemented within four months.

    (d) SC Judgement dated 08 Mar 2010 in the case of retired Defence Officer Association Vs Union of India. SC has ruled that the anomaly of 4th Pay Commission regarding rank pay which was removed by the Kerala High Court in one case is applicable to all officers who were in service on 1.1.86 and arrears will be paid to them with 6 percent interest. This judgement has for reaching consequences in that the pay and pensions of officers in 5th & 6th Pay Commissions would have to be worked out afresh.

    2. The President in her address had made reference to the welfare of Defence Personnel, and stated that lot was being done by her Govt. The truth is just the opposite. Infact, their status, respect and Pay and Allowances have been down graded. The award of 6th CPC has been very damaging to their morale.

    3. The Govt has shown total apathetic attitude towards their genuine demands. It is a sad reflection of the indifference of the Govt that Ex Servicemen (ESM) have been forced to sit on dharnas, go on hunger strike and return their coveted medals which are too close to the heart of a soldiers. It is sad refection of the Govt attitude that 22000 medals have been returned by the ESM on six occasions to express their anguish and hurt feelings. On 14 Mar 2010, the IESM delegation which had taken another 5000 medals to be handed over to the Supreme Commander, was denied the audience with her and feeling deeply hurt, they did not deposite the medals. However, they handed over the Memorandum signed in Blood by 6000 ESM to express their grievously hurt feelings to the staff of the Supreme Commander. The Govt continues to ignore their main demand of One Rank One Pension (OROP).

    4. Extremely severe conditions, extreme job expectations including supreme sacrifice, surrender of fundamental rights, forcible early retirement at his prime age of 35 viz the key role played by the Armed Forces in upholding the democratic values of the country and safe guarding the soverignity and integrity of the country make it a unique organization uncomparable with any other profession. Any tinkering with the ethos and morale of the Armed Forces would be at the country’s peril. A soldier’s life is particularly influenced by his service conditions listed below:-

    (a) Surrender of fundamental rights.

    (b) Accept even death as a professional hazard.

    (c) Live under extremely adverse physical and mental conditions during most part of service life.

    (d) Ignore even the hardships their families undergo, treating those as part of the sacrifice they are called upon to make.

    (e) Pass promotion examinations and attend courses of instruction in which non performance can effect ones career.

    (f) Maintain his physical fitness and clear selection boards at every rank from Jawan to Lt Gen to meet the requirements of a pyramidical organization. Only les than 1 percent reach the appointment of Hav major, and rank of Sub Maj and Lt Gen, amongst Other Ranks, JCOs and Officers respectively. While 100 percent of direct entrants in IAS and IFS reach the rank of Addl Secy and above.

    (g) Retire much earlier than the age of superannuation, as opposed to other Government employees and with no assurance of a second career. A jawan retires between 35-38 yrs. JCOs 42-48 yrs and an officer between 52-60 yrs (bulk of them at 54 yrs as only 15 percent hold the rank of Brigadier and above).

    One Rank One Pension (OROP)

    6. Implies that uniform pension be paid to the Armed Forces personnel retiring in the same rank with same length of service irrespective of their date of retirement and any future enhancement in pension be automatically passed on to the past pensions.

    The Govt’s High Powered Committee Headed By the Cabinet Secretary

    7. Had six other top bureaucrats of the country-Secretaries of Home, defence, Expenditure, Pensions & PW, DOPT and Ex-Servicemen Welfare. Since the government has accepted the recommendations of the Committee, reference to that report is relevant. It was expected that the Committee members, based on their experience and wide vision would come up with a fresh approach. Unfortunately, they failed to fulfill those expectations. The Committee only recommended that the dividing line between the pre-1997 and post 1997 pensioners be removed. They equated the pre -1997 pensioners with ‘post-1997 –and-pre-2006’ pensioners, thus removing a 12 years old anomaly. But the difference between the pre and post 1.1.2006 pensioners stays untouched.

    8. The Finance Minister and the Defence Minister while speaking on the floor of the House had created an impression, deliberately or otherwise, that OROP had been granted. However, the truth was masked behind clever use of words. Merely narrowing the gap between past and present is not OROP; removing that gap is. The hard fact remains that as of now OROP has not been granted. There is a large gap which exists even now after taking into account the 08 Mar 2010 implementation order of enhanced pensions of Jawans and JCOs. The following table would clearly show the same:-

    9. The Committee refers to reports of various earlier committees and Groups of Ministers (GOM) that examined the issue in the past. Somehow, it only quoted from reports that did not favour grant of OROP. For example, the Parliamentary Committee report headed by Madan lal Khurana had made a forceful case for OROP, going to the extent of saying that even if there was no precedent, it must be created now. This finds no mention in the present Committee report. Para 99 of the Report of Standing Committee on Defence (2003) clearly states: “The Committee have been recommending grant of `One Rank One Pension’ to the armed forces personnel time and again. The Committee observes that successive Governments and Pay Commissions have made improvements in the pension structure keeping in view the cost of living index. This has accentuated the disparity of pensionary benefits between pensioners of the same rank. The older pensioners who have become infirm in ability and capability and burdened with a larger social obligation receive pension calculated at the rate of pay at the time of their retirement in 1950s or 1960s or 1970s, which is quite paltry and the Dearness Relief quite inconsequential in today’s context of inflation and shrinking purchasing value of money. The nation must repay its debt to those defenders of the motherland with gratitude and humility. We should, instead of, looking for precedents in this regard, create precedents for the others to emulate. Any amount paid in this regard would be small token of our gratitude to them. The Committee, therefore, once again reiterates their earlier recommendation for providing `One Rank One Pension’ to the armed forces personnel”

    10. The Committee quotes from the advice of the Law Ministry to the GOM in 2005. “The pensioners as a group consist of persons with different number of years of service and different average pay during the relevant period. If all of them are treated alike by providing same pension while ignoring their respective variations in length of service and average pay, that may amount to treating unequal as equals.” When we consider that the demand of OROP is based on seeking equating among pensioners of same rank and with same length of service this legal opinion becomes irrelevant and reference to it is meaningless.

    11. The government had constituted this high powered body and it was expected that they would examine the problem de novo and inject some fresh ideas. Instead, they merely produced a summary of past findings and used it as the basis for their recommendations. This could have been done even by the junior staff, with the Secretaries merely pinning their signatures. The report does little to dispel the nagging suspicion that the constitution of the committee, and the statement of two Hon’ble Cabinet Ministers in the Parliament conveying an impression that OROP had been granted, was a mere diversionary exercise.

    12. A few facts regarding pensions of Defence Personnel are reemphasised as under:-

    All ranks who retired prior to 01 Jan 06 will draw much less pension as compared to their counter parts retiring after 01 Jan 2006 This is totally unjust, illegal and happens only in our Country.

    A Major General pre 2006 retiree will get far less pension than A Lt Col, who is four ranks junior, who retired after 01-01-06. Likewise , other senior rank officers ie Brig, Col, Lt Col, Maj, Capt, Lt, JCOs & Jawans who are pre 2006 retirees will get less pension than their counterparts who retired after 01-01-06. This is a weird situation which is also a blatant violation of Article 14 of the constitution. A senior rank officer must never get less pension than his junior rank officer irrespective of the date of retirement. The very functioning of the Army Rank structure is being adversely affected since the present serving personnel are the future retirees.

    There is far too large a gap — of Rs 11600 — between Major and Lt Col. Similarly, too large a gap has been created between the pensions of Major General and Lt Gen i.e Rs 9800/- The pensions of Lt Col, Col, Brig and Major General have been kept in a rather too narrow a range ie Rs 25700 – Rs 26700/-, a gap of only Rs 1000. The length of service and level of responsibility held have not been given due weigatage. Between Col and Maj Gen, the difference in pension is only Rs 650/-. The anomaly is too glaring. There should be sufficient gap, between the pensions of successive ranks and there should be no large variations within a particular rank.

    While implementing the Supreme Court judgment in the case of Maj Gens, the Govt has accepted the concept of granting the same pension to pre 96 and post 96 retirees with same rank and same service the plea made by Maj Gens when 5th Pay Commission was implemented. In the same way, the Govt should have applied the same concept in the case of pre 01 Jan 2006 and Post 01 Jan 2006 retirees of all ranks.

    Three Assured Carrier Progressions (ACP) concept has been accepted as 6th CPC award. But the same has not been applied to the past pensioners. The past pensioners should also be given the benefit of ACP by notionally applying the concept to them and their pensions fixed accordingly.

    · Successive Central Pay Commissions (CPCs) repeatedly and viciously lowered the pay and status of defence personnel. To mention just two cases, DIG of police, whose pay and status was in between that of a Lieutenant-Colonel and Colonel now stands equated with a Brigadier for pay etc. DIG rank comes after 14 years service while that of a Brigadier after 26-28 years. So absurd has been the dispensation that a Brigadier was given more pension than a Major-General. The Sixth Pay Commission introduced a dozen more anomalies.
    · Successive Presidents, Prime Ministers, Defence Ministers and the chairperson of the Congress party, at various times, accepted the grant of OROP. However, the bureaucracy has been frightening the political executive that giving OROP to the defence services will open a Pandora’s box. Every other government employee will ask for the same. This is patently false and mendacious contention.
    · In all, 83 per cent of defence services personnel retire between the ages of 34 and 37 years. Another 5 to 12 per cent retire at the ages between 44 and 52 years. Only 0.35 per cent retire at the age of 60. While all civil employees serve up to the age of 60 years, they step up to the top of their respective pay bands, get all the three Assured Career Progressions (ACPs) and consequently not only draw increasing pay but end up with much higher pension.
    · A comparison of the total amount drawn in terms of pay and pension by a soldier and pay by his counterpart in the civil by the time both reach the age of 60 years is Rs 33.3 lakh more for the civil servant; this figure at the age of 70 is Rs 42.670 lakh. At age 75, it is Rs 47.310 lakh. In the case of a Havaldar, his equivalent in the civil, at age 60, would get Rs 20.261 lakh more and this figure is Rs 26.639 lakh at age 70 and at 75 it is Rs 29.828 lakh. In the case of a Subedar, these figures at ages 60, 70 and 75 years are Rs 13.979 lakh, Rs 18.911 lakh and Rs 21.277 lakh respectively, more for the civil servant.
    · A soldier retiring at 35 years of age will live through at least four Central Pay Commissions and suffer their dispensations for retirees. Whereas his counterpart in the civil will not only continue to benefit from successive CPCs while still in service for an additional 25 years, but on retirement will be effected by just one CPC, assuming 70 years as the average age expectancy. Therefore, even if OROP is granted, defence personnel will continue to suffer these gross disadvantages.
    · Similar figures are available for officers. The disparities are due to early retirement, delayed and extremely limited promotions in higher ranks. All these features are service imperatives. Within the defence services, earlier retirees are further disadvantaged. A soldier who retired prior to January 1, 2006 will get far less pension than a soldier who retired after this date. For a Havaldar who retired prior to this date, his pension is less than a Sepoy who retired after this date.

    · The ad-hoc compensation promised to the other ranks is completely inadequate and fails to address the core issue of OROP. Similar situation prevails in the case of officers. Only one with severely impaired vision, limited intelligence and/or deep seated bias can miss the incongruity in this working.

    · The above disparities are independent of X factor which apply to only defence personnel. About 15 per cent of soldiers get the opportunity to live with their families for a period of one to two years in their entire service. In the case of others (including officers), only 40 to 50 per cent of their service, they live with their families. Then there are other travails of service such as harsh living conditions in uncongenial and high altitude areas which results in approximately 5000 of them being annually boarded out on medical grounds. Thousands live with ailments and continue to serve.
    13. The defence personnel by training and thought are mature, patriotic and therefore, will not ask for any thing which is not their due but if justice is denied to them they will go all out albeit peacefully to get what is rightfully theirs. The humiliations heaped upon the Defence Forces in the last 10 years is leading to lot of frustration and anger and therefore, immediate action to address their grievances is required to be taken by the Govt. We therefore request you the following:-

    (a) The judgements of the courts as mentioned in Para 1 (a to (d)
    be implemented in letter and spirit immediately and Military Pensions of Pre 2006 Pensioners be fixed accordingly.

    (b) Separate Pay Commission which has already been accepted by
    the Govt be set up immediately and all anomalies in the Pay and allowances and pensions .etc be transferred to it. The commission may please be given a fixed time frame say one year to resolve all anomalies. Two third members of the commission be from serving and retired Defence Personnel.

    (c) Military Veterans Commission be set up immediately which should consist of members from the Military Veterans only with all its powers as given to any other commission.
    (d) The Head of the ESW Department of the Ministry of Defence should be headed by a serving or retired Defence Officer. Besides that at the next level below the Head of the ESW Department, there should be one officer each from the Army, Navy and Airforce – serving or retired. Out of the remaining personnel forming part of the ESW Department, at least 50% should be from the Defence Services – serving or retired.

    14. Few seem to realise the strong bonding that exists between the veterans and the serving. There is continued interaction between units and their retired personnel and that is how units sustain the regimental spirit and traditions.
    15. During leave, the serving come in contact with the retired and the dissatisfaction of the later gets passed to the serving. Therefore, there is the danger of spill-over effect of this disenchantment and disgruntlement of the veterans passing on to the serving. It will indeed be a sad day for the country when this distress is fully transferred to the serving.
    16. The demand for OROP is fair and just and is only a part-compensation for early retirement, extremely limited promotions and a miniscule recompense for a hard and risk filled career. The political executive out to realise the injustice being done to the soldier and accept in good grace, what is fair and what is just.

    MILITARY PENSIONS AND ONE RANK ONE PENSION

    How It All Began With Independence
    1. The New Pay Code and the Pension Regulations 1950 were formulated on the recommendations of two Departmental Committees set up for the purpose. These were headed by senior ICS officers and included Finance and Armed Forces officers. The First Pay Commission for Central Government employees kept the Armed Forces out of its Terms of Reference. The Government recognised the distinctiveness of the Military and thereby followed the traditions of the Islington Commission of 1910.

    2. Pensions of the military were examined and reviewed by the Armed Forces Pension Review Committee (AFPRC). The AFPRC recognised the distinctive traits of military service such as truncated career, early retirement, the need to enforce the cadre structure through the “up or out” policy and most importantly the importance and relevance of rank to the military whether it be for officers or Personnel Below Officer Rank (PBOR). The Rank Based Pension (RBP) recognised
    · The age of retirement of every rank as it was different for each rank.
    · The years of service required to reach that rank.
    · The truncated career was compensated by a financial weight age given to every rank
    · The two factors which determined the pension of the rank were therefore age of retirement and service required to reach that rank. Normally the individual retired when he completed years required to reach that rank. Extension upto two years was granted but there was no change in the rank pension
    Demolishing Military Pensions And Its Civilianization
    3. As long as the Armed Forces remained out of the purview of the National Central Pay Commissions, the existing structure continued. Military Pensions continued to be higher than that of the CG employees. The Govt however decided to bring the Armed Forces under review by the CPCs and did so with the 3rd CPC. The terms of reference for the Armed Forces was very much different though they did not realise it then.

    4. The expectations of Armed Forces personnel were belied and the 3rd CPC recorded that the advantages of Service life were many and not available to CG employees. With regard to pensioners they opined that pension should be treated as a standby in times of adversity. The financial weight age was abolished and replaced by an arbitrary weight age of years of service to compensate truncated career. The fact that most PBOR left after initial engagement/colour service without pension was not addressed. It was left to Babu Jagjivan Ram to extend it to 15 years and make it pensionable. The impact of this move on the shortages of recruitment was immediately seen.

    5. The 3rd CPC in order to civilianise Military Pensions related pension to Last Pay Drawn (LPD) as a percentage rather than rank. The cadre and pay structure wherein service officers moved much more slowly to reach higher pay scales , mostly retiring even before they had a chance This resulted in Military pensions falling way behind their civilian counterparts, not withstanding the weightage for truncated career.

    GOVERNMENT REACTIONS

    6. Upset by the reaction of ESM, Govt appointed a committee under KP Singh Deo, MOS(D) to look into the Non Effective Benefits of ESM Pensioners. The committee recommended that service pensions /retiring pensions should revert to rank based. In fact it went one step ahead. Service Pensions should not only be rank based but all vintages of pensioners should receive the same quantum of pension. A new term was coined namely One Rank One Pension (OROP). The Govt announced in the Lok Sabha that it had accepted 26 of the committees recommendations barring one, namely on OROP which it was examining for implementation.
    WHAT WAS THE OROP RECCOMMENDED
    7. KP Singh Deo view was that Military Pensions as existed prior to 3rd CPC should be restored. Since Rank played a very important role in the military, reflected its ethos and retained Constitutionally after retirement, pensions had to be rank based. Every substantive officer and PBOR should receive the pension of the rank held on retirement which meant all Majors would receive a Majors pension irrespective of their vintage and date of retirement The pensions had to be periodically say after every 10 years enhanced to update them.
    OROP AND THE SUSEQUENT PAY COMMISSIONS
    8. Within a few years of the above report, the 4th CPC was announced. The COSC charged Major General MEA Krishnan to formulate a comprehensive report and proposals on pensions for submission to the 4th CPC.. The CPC accepted the recommendations of the MOD that since KP Singh Deo Report with regard to service pensions was under consideration nothing be changed at that stage. To alleviate the PBOR pensioners plight a ONE TIME INCREMENT was proposed and implemented.
    9. At the 5th CPC the Armed Forces Pay Cells in the Armed Forces Memorandum of Proposals made a strong plea for the grant of OROP. Whilst accepting the logic of OROP, the 5th CPC recorded that by giving to Armed Forces pensioners it would generate similar demands from civillian CG employees. They however recognised the plight of pensioners and introduced a system of parity and near parity amongst various vintages of pensioners. As of date the principle of parity and near parity as postulated by the 5th CPC is in force
    10. The various anomalies flowing from the 5th CPC award were at insistence of the COSC were considered by the Govt. A Group of Officers (GOO) was set up under CabSec with the three service Chiefs and practically every Secretary connected with Defence as Members. Secretarial cover was provided by JS (E) MOF and Chairmen of PCCs. The GOO met thrice a week at fixed times and agenda with members being requested to be personally present. After nearly three weeks of meetings finally a Report was produced. Pensions was also discussed which included OROP. It was about to be accepted when some of the Secretaries placed objections and the CabSec finally suggested that for the present the 5th CPC recommendation of parity and near parity be accepted.
    11. The 6th CPC whilst commenting on the demand for OROP repeated the same issues voiced by 5th CPC and stated that the principle of parity and near parity should be continued. Un wittingly perhaps the 6th CPC that the only category which was as per the OROP since their pensions were not as per the LPD but based on the rank and length of service on retirement.

    ALL INDIA EXSERVICEMEN MOVMENT IS BORN

    12. The ESM were deeply hurt and agitated with state of affairs with reference to their welfare. To meet their aspirations.
    Proposal of IESM for OROP.
    (a) Military Pension. All Ex Service Men irrespective of their date of retirement namely their vintage would be entitled to Military Pensions in recognition of the unique conditions of service applicable to them. All retirees of the same rank would receive the same pension irrespective of their date of retirement.Military Pension is unique to the Armed Forces personnel given for their conditions of service and has no relevance to the pension structure, rules and regulations which govern pensions to civilian Central Government employees.)
    (b) Implementation of IESM Proposal.
    (i) IESM accordingly proposes that Military Pension be granted to all pensioners including past retirees. It should be simple and easy to implement.
    (ii) It be determined with reference to notional top of the scale as given in the fixation tables given in SAI/SNI/SAFI issued post 6th Pay Commission. (All Stagnation increments in the scale of rank be included). Since the pension so computed would be related to 30 years service, it would be subject to pro-rata reduction for less than 30 years service.
    (iii) The over riding entitlement for an individual of pension being 50% of Last Pay Drawn once he completes 20 years service would remain. The ESM would have the option to choose the one beneficial to him.
    (iv) 50% of Military Service Pay (MSP) be added to the computed pension for all ranks.
    (v) It is reiterated that the pension thus computed would be applicable as on 01 Jan 06. Subsequently the pension be enhanced by the same amount by which pay is increased by increment. This will ensure parity amongst pensioners of the same rank and service.

    3. Recommendations of IESM.
    · We recommend introduction of Military Pension (MILPEN) to be implemented within 100 days of issue of orders.
    · MILPEN will be applicable to all retiring Servicemen including past pensioners.
    · MILPEN would be determined with reference to notional top of the pre revised scale (which would include all stagnation increments). This pension would be subject to pro-rata reduction for qualifying service less than 30 years. In addition 50% of MSP be added without any pro-rata reduction. The individual be given an option to choose between notional top of the pre revised scale of computing pension or 50 % of reckonable emoluments of the new scale, whichever is beneficial to the individual.
    · The pension so fixed on 01Jan 06 be enhanced every year by the same %age and at the same time so that equity is continued to be maintained in perpetuity.
    · Computation of Military Pensions thereafter is a mechanical process once the principles given above are adhered.

    5. Conclusion. The above structured pension scheme would ensure equation amongst all vintages of Military Pensioners in perpetuity thereby meeting the requirements of ONE RANK ONE PENSION.

    Sometimes back when Mr Tiwari was CM of Uttarakhand, there was a fire incident in a paint shop in Rudrapur. Mr. ND Tiwari came to Rudrapur in state government helicopter only to give away a cheque for Rs. Twenty Lakh to the owner. It was a nice act and we all appreciated it but we want to ask Mr Tiwari that so many sons of Uttarakhand had lost their lives fighting the enemy during this time, how many of them were given 20 lakh or more for the supreme sacrifice they had done ?

    As a “pashchataap” he must now fight for ex servicemen.

MLA who ateended the Assembly for 1 day getspension, Personal Staff of Minster’s after 2 years and 1 day’s service is getting pension. Defence personnel released on expiry of engagement with less than 15 years service is not geven any pension. It is understood in institutions are allowing pro-rata pension to people completed 10 years sercie. Can anybody enlighten in this regard by giving information for the benefit of such affected ex-Defence personnel

    Memorandum on OROP For the Hon’ble Petitions Committee

    Introduction
    1. Based upon the petition made to the Petitions Committee of the Parliament by the, Sh. Rajiv Chandershekhar , Hon’ble M P for granting One Rank One Pension(OROP) to the retired defence personnel , the said Committee has invited written memoranda from all cross sections of the society on the subject. Accordingly the same are sent as enumerated below .
    2. What is One Rank One Pension
    As per the Hon’ble Supreme Courts’ ruling ‘Pension’ is ‘‘Delayed wages for the services already rendered’’ . Therefore , all those who had rendered same services in terms of ‘Quantity’ and ‘Quality’, should get the same ‘’delayed wages’’, i.e. Pension , irrespective of their date of retirement . In the Military ‘Quantity of Service’ is measures in the terms of ‘Length of service’ and the ‘Quality’ is defined by the ‘’RANK” held . Simply put , all military persons , who held the ‘Same Rank’ and put in ’Same Length of Service’ under similar circumstances (category/ trade etc) be given the ‘Same Pension’ , irrespective of their date of retirement , i.e. those retired earlier MUST get the same ‘Delayed Wages’ (Pension) as the ones retiring now.

    Why OROP
    3. Up to second Pay Commission (in 1960s) military retirees used to get ‘Rank Based Pension’ i.e. One Rank One Pension’ in the form of ‘’Military Pension’’, wherein the old retirees got same pension as the new ones in the same rank . Also at that time , to compensate for their early ‘’FORCED RETIREMENT’’ to keep the military young , they used to get up to 75 % of their pay drawn as pension , where as the civilians used to get 33% of pay as pension , since the latter served for very long duration up to 55 to 58 years of age . However with the 3rd Pay Commission, the concept of the ‘’Military Pension’’ was done away and Military Pensions were ‘Civilianized’ and Military Veterans were merged with the civilians. Also the Military Veterans’ pension was reduced to 50 % and that of the civilians’ was increased from 33% to 50% of the last pay drawn . In addition , pension rules applicable to the Civilians, like getting full pension after 33 years, were made applicable to the military as well, fully forgetting that the defence persons could not put in 33 years of service, since they were forcedly retired , starting from 17 years , for a Sepoy. With each promotion they got couple of years more to serve and with the exception of some officers none could put in 33 years of service . Various wieghtage in years were given later to enable them to get closer to 33 years of service to get near 50% of pay. However with the wieghtage , no increase in ‘PAY’ was given .
    4. Service Conditions . There is NOTHING COMMON in the ‘Conditions of Service’ of the civilians and the defence personnel . That of the latter are MOST dangerous , difficult and extremely disturbed. Opportunities to live with family and bring up children are extremely limited. On an average a fauji moves on posting / turnover with his unit once in two years. This is in contrast with civil services that offer years of continuity in their station of posting. While logically it would call for a better and more empathetic approach in pay, perks and pension, there is an unfortunate effort to ‘balance’ the two, wherein the civil services come off better (eg Disability Pensions, Widow’s Pension etc which were made upwardly better before becoming applicable to faujis).
    5. Surrendering of “Fundamental Rights” On enrolement , the soldiers (term includes Sailors and Airmen) voluntarily surrender the Basic and Fundamental constitutional rights, like “Right to Life” in the larger National Interest’. Surely this great sacrifice needs to be recognized and suitably compensated. Granting of O R O P imethod of ‘Recognizng’ their sacrifices .
    6. With each Pay Commission Award , the pay of all ranks goes up but those who retired earlier their pension does not increase much because it is based upon old lower pay scales . While health related and other financial responsibilities of older retirees keep on increasing , their pension , which is a function of ‘Rank’ held , being peculiar to military only, does not increase proportionately . After the award of 6th Pay Commission , the difference in pensions for a Sepoy is about Rs 3000/- for those who retired after and prior to the applicability of its ‘award’ . This is grossly against the ‘Law of Natural Justice’ and violates Article 14 of our constitution which emphasizes need for ‘‘Equity’’. Also , the Hon’ble Supreme Court , in its judgment in September ’08 ruled that there could not be two scales of pension for the same rank but with different date of retirement as it amounted to creating ‘’CLASS WITH IN A CLASS’’ .
    7. In April ’10 the Hon’ble Supreme Court , in the case of Capt C.S Sidhu rebuked the govt NOT to treat Soldiers shabbily (actual wording was ,’’ Don’t treat them like beggars’’ , which was changed on plea of the govt pleader)
    8. Almost ALL the Militaries of the world get OROP. The British military has a ”Standing Board” to upgrade military pensions ANNUALLY . Please see website ‘’ ? Pensions – British Army website ‘’
    9. All secretaries to the Govt , Chief Secretaries , Director Generals of Police , MPs, MLAs , Judges , GOCs- in-C and many many more get One Rank One Pension . If they can get it , why deny to poor soldiers ?
    Progress So far
    10. To remove this anomaly , a Committee was formed in 1979 under K P Singh Deo , then an MP , who recommended that retired Defence Personnel of the same ‘Rank’, other conditions being same / similar should get same pension irrespective their date of retirement . This principle of O. R O.P. was accepted by number of Central Govts , on the floor of the Parliament , as a mark of gratitude to the Defence Services. Accordingly many Presidents , Prime Ministers and the Defence Ministers promised to implement the same . When it was pointed out that the other Govt employees would also ask for a similar treatment , Mr VP Singh, the then Prime Minister in 1990 , is on record having remarked , “ Let them (the civilian employees ) swap places with the military ” . But his govt fell before orders on O. R. O. P. could be issued.
    11. Mr George Fernandes then Defence Minister , announced at Anandpur Sahib (Punjab) in April 1999 that One Rank One Pension would be given in a ‘‘ Matter of days’’ . Mrs Sonia Gandhi , the President of the Congress categorically stated in a Rally at Chandigarh in November 2002 ,that when their party came to power it would give OROP . The ‘Standing Committee on Defence’ (13th Lok Sabha) studied the problem and made suitable recommendations in its “20th Report’’. One of its recommendations was that the OROP be implemented . It even went to the extent that a ‘Precedent’ be made in this regards . This ’Report’ was tabled in both the houses of the Parliament by December 2003. But the NDA govt fell in May 2004. However the issue was also included in the President’s address to the Parliament in 2004 .. Again , the UPA govt’s Parliamentary Committee on Defence , Chaired by Mr Satpalji Maharj recommended One Rank One Pension in its report on 07 May 2010. All major political parties including Congress party had included the point of One Rank One Pension in their Lok Sabha election manifestos. That makes OROP the declared policy of the Government and ALL parties , not just of any one political party .
    12. After a lot of hard struggle including return of War Medals, holding of number of Rallies , observing ‘Relay Hunger Strikes , SIGNING IN ”BLOOD” and all other peaceful means through out the country, lot many promises were made including by the President on 04 June 2009 but the Bureaucrats kept creating hurdles. Media support to the One Rank One Pension including the recent debates on TV made little difference to Bureaucrats since they have no answers to give .
    13. Not giving OROP will lower the morale of the serving soldiers , since they too would be retiring one day. ”MORALE” , as you know, is a ”BATTLE WINNING FACTOR” . Lowering of morale of the military will weaken our NATIONAL DEFENCE .
    14. Finally , KAUTALIYA’s Advice to Emperor Chander Gupt Maurya , reproduced below ,is relevant to us also
    “ If ever things come to a sordid pass when, on a given day, the Mauryan soldier has to LOOK BACK over his shoulder (simhawalokana) , prompted by even a single worry about his and his family’s material, physical and social well being, it should cause you and your Council the greatest concern and distress. I beseech you to take instant note and act with uncommon dispatch to address the soldier’s anxiety. It is my bounden duty to assure you, My Lord, that the day when the Mauryan soldier has to demand his dues or, worse, plead for them, will neither have arrived overnight nor in vain. It will also bode ill for Magadha. For then, on that day, you, My Lord, will have lost all moral sanction to be King! It will also be the beginning of the end of the Mauryan Empire!!”
    Why not to others?
    15. The answer to the question ,” If we give OROP to Defence personnel, others will ask the same” is , “Yes please give OROP to all those who retire before the age of 60, yes give OROP to all those who join the service with the condition that they are willing to sacrifice their lives while performing service, yes give OROP to those who have been denied the fundamental rights by the Constitution of India, yes give OROP to all those who spend major portion of their young lives away from their families …and so on.
    16. Is asking the views of ALL justified? . It is submitted that asking views by the Petition Committee of the general public , who are ”Un affected” and are ”Totally Unknowledgeable ” about the Military or the OROP , is NOT correct . Only those who are ”Concerned” / connected” and are ”EXPERTS” on the subject / problem be asked such views . Those who know NOTHING about the military and its harshest and most exacting working conditions MUST NOT be able to influence the thinking of the Hon’ble Committee on OROP . Is it justified to ask all and sundry to comment on the terms and conditions of brain surgeons or nuclear scientists ? If not, why should they be asked to comment on them ? Similarly those who know nothing about the Military are thus NOT qualified to comment on it . It appears to be Bureaucrats’ conspiracy to deny OROP to the Military Veterans on the grounds of comments by some ignorant persons which may be against it.
    Conclusion
    17.. Demand of One Rank One Pension is MOST genuine and has been projected with ALL peaceful means . It is learnt that the political leadership is willing to concede , but the wily bureaucracy is opposing it because they DO NOT want the Military Veterans paid well for the reasons best known to them. It is time the political leadership asserted to raise the MORALE of the Military and accept the demand of One Rank One Pension in the “NATIONAL INTEREST”.

BSP etc, OR our dear SUPREME COMMANDER or JUDICIARY or RULING PARTY i.e. UPA-II) who can see the truth/realty/injustice to the Nation/Public (at large & the personnel of the Defense Services, both Serving/IESM; in particular) and raise their voice against the INJUSTICE being done to ALL THE DEFENCE SERVICES’ PERSONNEL (both SERVING and RETIRED) who are directly affected due to the game played by the AUTHORITIES, RESPONSIBLE FOR IMPLEMENTING the awards of the CPCs. EVEN THE SERVING PERSONNEL too would be directly affected by the increase in their Pay Scales…..as a result of higher basic pay, after the award of IV CPC and also the subsequent awards and also the FUTURE CPCs..which are based on the last pay drawn. This is causing such a SEVERE BLOW TO THE PEOPLE IN UNIFORM and whose morale (and hence the health of the Nation) is directly affected by such IMMORAL ACTS. I am surprised that these things (i.e. filing of review petitions and all) are happening during the premiership of one of the best and highly educated & respected (and not an illiterate POLITICIAN—in the real sense) PMs of Independent India. I pray to God that good sense prevails in the minds of the POWERs that be and they do not take the DEFENCE SERVICES for GRANTED and it does not BOUNCE BACK. The politicians will realise this on their own peril BUT BY THAT TIME IT MAY BE TOO LATE! LET US INITIATE SOME DRASTIC ACTION and MAKE IT A MASS MOVEMENT.

    Dear Major Saini & All Ex-servicemen,The word PBOR is no more in use as it has been banned by Integrated Headquarters of MoD. This has been published in News Paper ‘Hindustan’ of dated 04-03-2011 so each military person should be addressed with respect and Rank only. Thus, we are still bounded with rank and file and follow the norms in which we have been molded in the military environment. Should we scare off such political involvement. I feel present political system in India is deepening the gap between Rank and File and also dividing the Military Personnel on the basis of caste ism. We recognize ourselves as Indian Fauji and no discriminatory treatment is given while dining on same table, fighting together against enemy, getting pay as defined in services. Then, why we are divided on the basis of reservation after getting retirement since we had been equal while being in services. Perhaps, this policy needs changes and reservation should be on the basis of ‘Fauji’ class and not on the basis of divisive factor casts and creed. This might be the main factor which cannot bring as closer as we had been in active service. Thus, talking of government and its policies is not logic and we should look into ourselves.Regards and duties should not be bonded within the pages but facts should be looked into by the serving officers or Chief of Army/Navy/Air force staff. This would be certainly a favorable and positive point to strengthen our serving and retired military personnel.

    Revered Flag Officers(Retd) and other Ranks(Retd), I have gone through almost all comments given by all retired officers and other ranks of high caliber and intellects. I am nothing to comment on my superiors as the rank and status and due respect remain same until death. To talk of revolution and criticizing Government is easy but to select the right path of resolving the difficulties and to find root of anti military policies of Government is a tough task. Such impossible task are completely based on the recommendation of Senior Officers in active services and routed through the channel chief secretary, defence minister etc. Improvement within the system in active service can solve such problems. Senior Retd officers should think for that.

    It is ofcourse true. But whilst in service, the Senior Officers (Flag Officers)are having restrictions to fight for our rights, because they have to foresee their further portfolio and promotions since those are assigned only with the support of these illiterate bureaucrats.
    I request Maj Saini sahaab, to insist two or three Retired Flag Officers to try forming an Union or an association or even a political party. The growth of the same may be slightly slow at the initial stage, but it will blossom after a specific period. We know to be silent, obedient, disciplined,beg, remain hunger and even to fight.

    One should come forward to serve for the served. Who is that ? Let us wait and see.

Every serving military man has to be become an ex-serviceman. Do you believe that present declining attitude of Government, somewhere effect the morale of active service personnel. If so, why our retired senior officer are not coming together with serving senior officers to bring into the notice of government. This would be more beneficial to counter the present bio- face/multidimensional threat to our nation as well as to keep the morale of fighting force high.I believe a small and right step in this direction can solve the problem of serving as well as retired military personnel.

    I would like to bring into your notice, How our Govt is cheating to us on the name of welfare. Recently we surprise to see that reservation in the AIEE 2011 has been removed from this year. One side they are making publicity that they are providing lot of facilities (reservation) to the Ex-Servicemen.
    Our while youth hood was looted and now we had to depended on their (Govt)help, what hell is this. Is there any solution to fix this kind of issues. This way if continues one day ESM would start begging. I think we should use media whenever possible to educate the people.

Yes, we can build a nation-wide organized team segmented into state-wise elected teams with a handsome fund contributed by all the members. The example of Hon. Anna Hazare is really a motivational factor. We should act like Anna Hazare. He has spent his life without any self interest. He has not married due to the reason of serving to the nation and draw a line from where he becomes a ray of light to the entire mass of India. But, on the other side, we speak and put our thoughts to the media which are spread all over and give us fruitful results.

    The time has changed, it is an era of Information technology, that’s why we are able to get united and act accordingly. off-course, the dumb and deaf government has no sentiments towards the Patriot soldiers who save the mother land from not only external enemies but also from the one from within ourselves.

You should obtain complete information from records and then justify your self.     Please go through Circular 430 of 10 March 2010 followed by the details related to enhancement of benefits of pension by GOI. You just fill up Appendix ‘A’ through your PDA (Bank) for revision of disability benefits. Open website PCDA, then click government orders reflected towards left and then important orders/circulars and enter. You will reach the page of important circular and you will find the Circular 430 as an ‘Important’ circular. As per disability benefits, 20 to 50% as under one slab; 51 to75 second slab and 76 to 100 is the third and final slab for the disability benefit only. I have confirmed through known resources. Please go for that.

    I have gone through various comments expressed by my revered ,experienced and learned ex-servicemen.I am not able to understand why so much time is being wasted on orop issues.You have suffered while serving in defence because your genuine problems were not projected to higher authorities in a proper way and at appropriate time.Today how can you expect some miracle from your govt.? Your govt. know that you are unorganised,surronded by so many family and social problems,after leaving service.Mere Writing in blogs is not going to bring out any fruitful results.There are so many ex servicemen who arein parliament and holding important portfolios.Can we just ask them why they have not taken up orop issue inside the parliament? They will not! Why? Next time they will not get ticket to contest election if they go against the wishes and norms of their respective party high commands.
    We all have served in different units,environments,with different people and for different goals. We are different from our civilian broters in many aspects.Training imparted to us has filled us with so much confidence and energy that our civilian counterparts can not even dream of.What makes relationships,communities,countries and men great are not the things that we have in common but the differences that make us unique.So let us not waste time on orop issue and try to make the best use of our leftover life.
    You might have joined armed forces due to various reasons and let our children not commit this mistake.Let them not get blackmailed in the name of serving our country.I would like to advise my esm brothers who left service at young age, to get their children highly educated . There is no dearth of opportunities if your children are highly qualified.
    And finally I would like to add

    The heights by great men reached and kept
    Were not attained by sudden flight
    But they, while their companions slept,
    Were toiling upward in the night.

    This refers to the comments written by shri P Saini above. Yes , Saini sab identified certain points about our past life ie in the forces and some in the retired life. Yes, civilian babus are not ready to accept the armed forces unless there is war. The IAS lobby did everything for their present and future , in the meantime they succeeded in reducing the benefits that have been granted to the exservicemen. Our Generals if objected to strongly that or this time, the Govt would not have dared to accept these dirty tactics. Even now our serving Generals are not coming strongly to convey the govt about this injustice, if it happends, it wont take more than 24 hours to settle the issues. But if they protested, yes, they cannot get the posts of governors and ambassadors.
    Any how, presently what the leaders of the IESM doing is defenitely in the right direction, day will come, the IESM will achieve it, because these are genuine points.
    Nobody can appreciate the fact that with 6000 rupees pension, an Exserviceman cannot run the family. Please attend the rally which has been announced for 12th Nov, give the full support.A peopn in the civil is getting better pension. The officers of the serving and retired must raise their voice aginst the degradation. It is high time.

Plse kindly let us know through wide publication which would ensure a good number of ESMs participation like in News Papers, TVs (National & Regional),Websites and even flex banners in District HQs. For such advertisements, the IESM may please be advised to cantact DSSABs, Ex-servicemen League etc.

    ‘Prayer’-The power that pulls everything together successfully. Every principle I have shared with you all ESM of Indian soldiers in these pages is key ingredient in the recipe for success. We come now to the final and most important stage necessary for effective organizational management. If we have followed all the steps outlined earlier, then by now we have:

    (1). Put our problems in proper perspective,
    (2). Applied the principles of managing problems positively,
    (3). Taken charge and control of situation,
    (4). Tackled impossibilities with the Ten Commandments for
    Possibility Thinking,
    (5). Counted to ten and won, &
    (6). Applied the faith that will move our mountain.

    But each of these stages, understanding and overriding all the principles we have developed in the preceding stages, there must be a steady and unfailing practice of positive prayer if we are to succeed.

    Decision-making is easy if there are no contradictions in our value system.

    There were several and innumerable cases, incidents, occasions where only the Ex-Servicemen ORs/NCOs/JCOs(PBORs)=Unemployed-;re-employed-pensioners-widows-dependents’ category got deprived of from their Legitimate share, Constitutional rights, Social privileges and benefits from all spheres of life like lateral induction, reservations and its implementation and compliance with in letter and spirit in the fields of (re)Employment, educational institutions, allotment of several impelling projects/schemes like petrol bunks, Specialist Doctors’ consultations/ referral to Corporate Hospitals, CSD facilities/sharing of profits, discrimination in allotment of houses/Flats by AWHO, sanction of Security Agencies,– treating them as an ‘untouchable’, unlike the other category of similarly defined Ex-Servicemen Officers. One of the glaring example where this suppressed category was denied their due share and affected adversely is especially in the filed of Reservations in the Employment-Public or Private, Corporate level or Industry level.     In a recent case, the Hon’ble Supreme Court has held that General Category candidates who crack competitive Examinations but end up getting waitlisted for want of seats can’t be accommodated against posts belonging to the reserved category even if they are lying vacant.(emphasis added: in our case it is just reverse, since there is no monitoring authority)

    The ruling came in a case relating to appointment of District Judges in the Delhi Judicial Services. It was alleged by aggrieved candidates that after filling up of the 13 posts notified for the general category posts which were vacancies in the reserved category posts which were not filled and hence those on the top of the merit-cum wait list be considered for the same. A Bench comprising Chief Justice KG Balakrishnan and Justices Deepak Verma and BS Chauhan rejected the petitions saying it would be patently illegal to appoint persons in excess of the notified vacancies. “Any appointment made beyond the number of

    vacancies advertised is without jurisdiction, been voilative of Articles-14 & 16(1) of the Constitution, thus a nullity, inexecutable and unenforceable in law”, said Justice Chauhan writing the judgment for the apex court Bench. [Quota Prevails: Details: (i) in May’07, 20 posts for Delhi District Judges announced=13 for general category and 7 for SC/STs; (ii) All general seats were filled up, but 2 SC & 4 ST posts were vacant, (iii) Hon’ble Supreme Court says that advertised number of general posts were filled up. Waitlist to be “consigned to record room” despite SC/ST vacancies].

    The merit list for general category is just for that category, the court has held in its fresh intervention in the “merit Vs. social justice” debate.

    Whereas in the case of ORs/NCOs/JCOs(PBORs) Ex-Servicemen there was no such monitoring machinery(Authority) by Legislative proceedings to follow up whether the posts/seats reserved for ESM have been actually filled up with our ESM category/ dependants/wards or not, unlike the other categories like SC/ST/OBC which have Constitutional protection as well as executive empowered questioning authoritative machineries are functioning very effectively from primary level to the highest top end level. If any thing goes wrong by chance, they successfully stall even the Constitutional functions, but such Questioning Authority is totally absent in our case of ORs/NCOs/JCOs(PBORs) Ex-Servicemen.

    If you observe the above judgment you feel that the posts and seats reserved in employment and educational institutions respectively; quotas reserved for allotment; assignment of Agricultural lands and house sites and industrial estates are preserved and in other avenues for the ESM category are not filled up from ESM category and the actual position not known to even the directly affected aggrieved ESM, leave the ESM organizations which were made just spectators and powerless. But the concerned authority show their magical statistical figures covered with false and fictious data information in reverse.
    In case, there are any back logs, the unfilled vacancies should be carried forward and the same should be filled up from ESM category only which is in vogue in other reserved categories cited above, based on which the above judgment was delivered. In the recently held Banking recruitments all over the country in ALL Banks, the number of vacancies notified for our ORs/NCOs/JCOs(PBORs) ESM category were never filled up as per the notifications issued by each individual banks, leave to the strict implementation/compliance with the Reservation policy promulgated by the Central Govt as well as byall the State Govts. Ref No. NEXCC/AP/GS/VC/87/09 dt.20-09-2009 inter-alia about 23 other issues, brought to the notice of the Director of RSWB reminding him his duties and responsibilities as enumerated by the KSWB in this regard, for taking immediate and suitable action against the erring concerned authorities.     IT IS NEVER TOO LATE TO MEND

    Err is human. Every mistake is a lesson, thus a living sermon. The tendency to correct mistakes should be appreciated. An intelligent and aspiring individual never repeats the mistake a second time. It is never too late to rectify one’s mistake and come to the right way. One should not get shy or ashamed of to follow the noble deeds and choose the right path. Unity is the ultimate goal for which the people can have great deal of harmony of agreements and complete accordance among individual persons regarding attitudes, opinions, intentions, aspirations, goals, welfare, success etc., which are combination of different positive parts of achievements. We learn from past history, where Kings, Princes, Rulers-Rajas, Nawabs etc., who are quite disunited, acted independently, nay some times took shelter, assisted or partnered with foreigners/alien enemies leading to easy invasion of the Bharath. Results, people of this country miserably suffered, irrevocable losses occurred, decades passed to recoup. The present trend of ESM is similar to them, tiny and small groups come up, pseudo Welfare Organizations spread. Now-a- days one can see in each galli there is some kind of ESM Assn is taking birth in a overnight. Whether the profounders of these tiny units and fungus mushrooms have got any competency, confer any moral rights to show off! Whether they are genuine and honest for the just cause of mass ESM and their dependents! Whether they are competent enough to shape for catering expertise services to the needy! Are these dispelled tiny groups are competent to represent to the highly educated, trained, experienced, the intellectual class of bureaucrats and tricky politicians in proper perceptions! The past three decades history proves some negative results on certain issues due to divisive forces were working within us. Due to this fungus, we lost recognition, sanction of funds stalled, we are not in a position to impress the authorities due to lack of unity among us. Whereas the small civilian groups achieving their demands within a short period with ease even on caste, community, race and religion planks shaking the democratically elected State as well as the Central Govts. Therefore, the ESM shall be very cautious before taking decision to join in these mushroom tiny segments of breakaway groups. These units are making immense damage to the ESM community. Their goal is just to accomplish self-needs but not to fulfill the welfare programmes of the ESM mass and their families.

    There are numerous of genuine problems, facing by the ESM especially the ORs/NCOs/JCOs/Hony Ranks/ECOs/SSCOs to be addressed at once. The problems which are many to be resolved by various Govt Agencies on different Forums on ‘MOST PRIORITY BASIS’ as they are half-Century old.

    Today’s concept is ‘ONE WORLD-ONE RULE’ and Global Harmony, peace and tranquility and brotherhood. In our ESM community at some corners few tries to become a self-styled leader in a overnight without possessing the minimum required eligible criteria unlike the Politicians which is quite different phenomena of either muscle power, money power and other extra-constitutional intricacies. Politics as a science, may make a man a clever statesman, but it may not always enable him to discern true policy in his private concern. See the present trend, a vast political division across Indian territory–regional, sub-regional, divisional sub-divisional, local, sub-localwise for self-growth with ‘SCAMS’-caste-community-race-gender-religion committing political offences through municipal legislation and through executive modes.

    There are tens of hundreds of ESM organization in our country from village to national level with different names and boards approaching/representing to the Govt agencies on different matters which are common, but what will be the impact on our community as a whole, is zero. Instead of be nucleus, if these small ESM organizations take ‘AFFILIATION’ with the national Forum like ‘NATIONAL EX-SERVICEMEN CO-ORDINATION COMMITTEE’ (Regd) & ‘ALL INDIA EX-SERVICEMEN BANK EMPLOYEES’ FEDERATION’ (Regd), as the case may be, keeping the individual’s identity intact without any disturbance, the results shall be tremendous and fruitful without any doubt. Success shall adorn through united forum with able leadership. Generally outside agencies apply ‘divide and rule’ policy, but here we are dividing ourselves without application or intervention of any outside force, sheerly for selfish and Self-styled leadership.

    The time was already ripe for us to introspect that how our ESM become a potent tool in the hands of few self-styled leaders to divide our community. Why does, I ask, divisive forces within us play dirty role obstructing the lines of success, when we claim to have ushered in the present century. It needs to address to curb the rising denominationalism strife between the same class of community which may give pointing out to the entire ESM community. Therefore, it is my humble request on behalf of ‘NATIONAL EX-SERVICEMEN CO-ORDINATION COMMITTEE’ (Regd) & ‘ALL INDIA EX-SERVICEMEN BANK EMPLOYEES’ FEDERATION’ (Regd), to all individual ESM as well as other ESM group of organizations in the country come together to serve our community united, leaving behind individual ‘ego’ far far away.     Dear PDP Ganeshan, I had also read in Hindi Jagran about a week back that withjin 3 months all central government pensioners retired before 2006 will get the same pension as persons retired after 2006. But it was not in other papers nor there was any follow up in Dainik Jagran. It may be correct or as usual we are being shown a false promise !
