Bhopal gas tragedy: CBI moves Delhi court for Anderson’s extradition
March 22nd, 2011 - 10:20 pm ICT by ANINew Delhi, Mar 22 (ANI): The Central Bureau of Investigation (CBI) moved a Delhi court on Tuesday to obtain a ‘Letter Rogatory’ to the US authorities for extradition of Warren Anderson, the then CEO of Union Carbide India Limited, to stand trial for his criminal culpability in the 1984 Bhopal gas tragedy.
The investigating agency, which submitted a 33-page application to Chief Metropolitan Magistrate Vinod Yadav in the Tis Hazari court, said Anderson should be extradited from the USA to face the trial which is pending against him in the court of Bhopal chief judicial magistrate.
“Warren M Anderson is liable to be prosecuted on extradition to India for offence under section 304 IPC (culpable homicide not amounting to murder),” the CBI said.
“The offence involved in under section 304, 326 IPC which entails more than one year imprisonment are covered under the provision of dual criminality as these offences are punishable in India as well as in the USA,” it added in its plea.
In the early hours of December 3, 1984, around 40 metric tonnes of toxic methyl isocyanate (MIC) gas leaked into the atmosphere and was carried by the wind to the surrounding slums.
The government says around 3,500 died because of the disaster. Activists however calculate that 25,000 people died in the immediate aftermath and the years that followed. (ANI)
