Aarushi case: Rajesh Talwar moves Allahabad HC challenging bailable warrant

Allahabad, Mar 10 (ANI): Rajesh Talwar moved the Allahabad High Court on Thursday challenging a bailable warrant issued against him and his wife Nupur Talwar by a special Central Bureau of Investigation (CBI) court in Ghaziabad in the murder case of their teenage daughter Aarushi and domestic help Hemraj.
The Allahabad High Court had on Wednesday reserved its judgement till March 18 on a petition filed by Noida-based dentist couple Rajesh and Nupur Talwar, who challenged a Ghaziabad CBI court’s order, which made them the main accused in the murder case.
Talwars’ counsel Samit Gopal said, Rajesh Talwar has challenged the CBI court order dated February 28, whereby bailable arrest warrants of Rs. 20,000 each were issued against them and their plea for exemption from personal appearance was turned down.
A special CBI court in Ghaziabad on February 28 issued bailable warrants against Dr. Rajesh Talwar and his wife Dr. Nupur Talwar in connection with the murder case.
The court also rejected the plea of the dentist couple for exemption from personal appearance before the magistrate.
The Talwars had been summoned by the court to appear before it today after Special Judicial Magistrate Preeti Mishra, on February 9, rejected agency’s closure report in the double murder case and made them accused on charges of murder, destruction of evidence and common intention to commit the crime.
The Aarushi Talwar murder case witnessed a dramatic turnaround on February 9 with the Ghaziabad court accusing the Talwar couple of killing their daughter.
Talwars were charged under Sections 302, 201 and 34 of the Indian Penal Code (IPC).
On February 9, the CBI court had directed the investigating agency to prosecute the Talwars for the murder of 13-year-old Aarushi and Hemraj. They were also accused of criminal conspiracy and destruction of evidence.
The CBI court had given its orders following submission of a closure report by the CBI, which named Aarushi’s father Rajesh Talwar as the prime accused, but said he could not be prosecuted due to lack of evidence.
The Talwars want the high court to cancel the order passed by the Ghaziabad CBI court and direct agencies to carry out further investigation in the case.
Aarushi (14), was found murdered under mysterious circumstances in her parents’ Jalvayu Vihar apartment in Noida on May 16, 2008. The next day, their domestic help, Hemraj’s body was found on the flat’s terrace. (ANI)
