Environment ministry warns Nirma to abide by green notice

New Delhi, March 15 (IANS) The environment ministry Tuesday cautioned Nirma to abide by the stop work order issued last week, otherwise it will be constrained to take the dereliction into account when deciding upon whether to make the closure notice permanent.

The ministry on March 11 had issued a show cause notice under Section 5 of the Environment (Protection) Act, 1986 for permanent suspension of work and revocation of the environmental clearance against the company’s cement plant in Mahuva block of Bhavnagar district in Gujarat for violating green norms.

After the stop work notice, Nirma vice-president V.N. Desai had written a letter, calling the notice “illegal, unjust” and “against natural justice” and refused to obey the instruction.

The ministry Tuesday wrote a letter to the company, instructing it again to cease and desist from taking any actions at the site pending a final resolution by the ministry.

The ministry said that show cause notice was issued based on the findings of the expert appraisal committee (EAC), that the plant is expected to cause irreversible damage to the wetland.

“If you do not take immediate action to comply with the show cause notice, then we shall be constrained to take said dereliction into account when deciding upon whether to make the closure notice permanent,” the letter said.

The ministry said it was awaiting a detailed reply from Nirma on merits on the issues raised in the show cause notice.
