Sophia Stewart wins the Matrix copyright infringement case

New York, Nov 11 (THAINDIAN NEWS) Sophia Stewart an African American who claimed to be the author of The Matrix will finally receive her just due from the copyright infringement of her original work, as the copyright case is finally settled in court.
A six-year dispute has ended which involved Sophia Stewart, the Wachowski Brothers, Joel Silver and Warner Brothers. Sophia Stewart’s allegations, involving copyright infringement and racketeering, were well received and completely acknowledged by the Central District of California, where the Judge Margaret Morrow was presiding.
Sophie Stewart had filed her copyright infringement case 10 years ago, in 1999, after viewing the acclaimed movie Matrix, which she felt had been based on her manuscript, ‘The Third Eye,’ copyrighted in 1981. In the mid-eighties Stewart had submitted her manuscript to an advertisement placed by the Wachowski Brothers, requesting new sci-fi works, which could be later made into a movie.
According to court documentation, “an FBI investigation discovered that more than thirty minutes had been edited from the original film, in an attempt to avoid penalties for copyright infringement. The investigation also stated that ‘credible witnesses employed at Warner Brothers came forward, claiming that the executives and lawyers had full knowledge that the work in question did not belong to the Wachowski Brothers.’ These witnesses claimed to have seen Stewart’s original work and that it had been ‘often used during preparation of the motion pictures.’ The defendants tried, on several occasions, to have Stewart’s case dismissed, without success”.
Sophia Stewart’s released a press statement which said: ‘The Matrix & Terminator movie franchises have made world history and have ultimately changed the way people view movies and how Hollywood does business, yet the real truth about the creator and creation of these films continue to elude the masses because the hidden secret of the matter is that these films were created and written by a Black woman…a Black woman named Sophia Stewart. But Hollywood does not want you to know this fact simply because it would change history. Also it would encourage our Black children to realize a dream and that is…nothing is impossible for them to achieve!’

This story is false. Sophia Stewart never won a court case over this, as this was all dismissed or thrown out four years ago. She did not write The Matrix. She did not write The Terminator. She is a fraud.

**NOVEMBER 2009 UPDATE**: Sophia Stewart uncovered the fraud in both cases. As you know two sentences of fraud overturns or wins the court case, because a judge cannot aid or abet in a criminal scheme. Sophia Stewart has proven she wrote the Matrix & Terminator. Judge Brooke C. Wells ruled that the evidence (30 counts of fraud & perjury) stand August 11, 2009. Sophia Stewart won both cases and media is welcome to look at the evidence!
Her crooked a** lawyers HAD THE EVIDENCE, HID THE EVIDENCE & DIDN’T SUBMIT THE EVIDENCE which constituted outright fraud!!

Fortunately, Sophia’s case illustrates how to beat rampant fraud & theft.
It is time to explore the fact that the rampant fraud & theft in Hollywood may not be adequately revealed by simply “comparing scripts”.
Why?
Because of the likelihood that the perpetrator’s “phony scripts” (aka source material) may not resemble what’s actually on screen; making “phony scripts” a moot point.
This is where [verbatim] proves “access”, “copying” and “substantial similarities” of the Constructive Trust Pacific Western Productions which was a shell company that produced the 1:45sec [verbatim] out of Stewart’s 81 Third Eye Movie Treatment.
Now, the simple questions become:
“Do clever thieves register stolen goods”?
And better yet,
“Is registering stolen goods an actionable offense”?
Unless I’ve been misinformed, the famous line of Gov. Schwarzenegger “I’LL BE BACK” is a direct quote out of Stewart’s 81’ copywritten work.
In Stewart’s case, the perpetrator’s phony “source material” bears no resemblance to what’s on screen in both sets of Terminator & Matrix films.
Again, this explains why Stewart’s former lawyers “had the evidence”, “hid it” and “did not submit it” to the California courts.
I suspect there is a very sound & logical reason why thieves don’t register stolen property.
As you know, fraud is used to “hide the theft” and thereby “hide truth”; not compliment truth.

I made a few comments on a livelier webpage (http blackauthors.ning.com/forum/topics/black-author-wins-the-matrix) and exited because the idea of proof or reason is not respected or relevant in this discussion. I am here merely to offer these thoughts:
Let’s explore this.
Die-hard posters can not specify what elements were in Sofia Stewart’s original piece, yet they are certain that those elements were used to an extent that gave the lawsuit legal standing. (How much do you want to bet that they have not even seen her book?)
They do not seem to understand that it is logically impossible to disprove a negative. A negative such as there was no substantial proof offered that there was any copyright infringement becomes “they refused to see what was put before them.” (Former Beatle George Harrison was found guilty of plagiarizing the melody of “He’s So Fine” in his “My Sweet Lord” and paid money appropriately. A white boy got busted and had to pay some lowly song-writer(s) from the 1960s, but when Ms. Stewart does not win, therefore it was a conspiracy. 1 + 1 = 534987.)
But wait! It was unproven because she did not show up for a critical court appearance. Oh, no, that was not of her own free will. When she didn’t show up for the court appearance, it was because she was tied up somewhere by lawyers who did not want their percentage of “billions” of dollars in settlement or royalties in arrears. The fact that none of it was reported anywhere PROVES that it happened.
Somebody else states that it is still in litigation. No source for the “fact” they asserted.
They ignore any reason-based discussion and fly to the defense of Ms. Stewart by attacking whoever seems emotionally invested in the counter position(s). They react to the fact that Joe the Man reacts to them; what he says is handled by whichever part can be attacked as having been an attack; nothing to do with reasonableness.
They ignore or choose not to respond to the article by Sergio, that he pointed to in earlier posts, at http http://www.shadowandact.com/?p=11948.
They ignore the fact that the reappearance of exactly the same story four or five years later clearly shows the re-cycling of an internet fable AND also ignore the fact that the college newspaper that is responsible for its re-appearance checked themselves and acknowledged that it was erroneously taken as new news while withdrawing support for it (as laid out at the Snopes.com webpage on this “controversy”).
What is happening here is the same kind of non-communication that characterizes most “discussions” — not only among Black Americans — in which one of the parties acts/thinks as though fact is determined by belief and desire. The indication of this irrational approach in actual face-to-face discussion is the kind of argument that is based purely on the idea that whichever party can talk the loudest and/or the longest is the winner. If I can be the winner I can make it so, as Captain Picard liked to say.
Thinking, rationality, logical attempts to determine truth — none of these are important when a person’s mentality is that truth is determined by the winner. As the satirical saying goes, “Don’t confuse me with the facts; I’ve already got my mind made up.”
It reminds me of another saying I read or heard somewhere: “Never try to teach a pig to sing. It annoys the pig and frustrates you.”
And one more: “I refuse to have a battle of wits with an unarmed person.”
This tendency to believe in someone because you want to is exactly how confidence crimes work. Ask Bernie Madoff’s “investors.” In one way or another the person who is taken chooses to operate solely on their “feeling,” facts be damned, doubts ignored.

i just read a little of what appears to be the copyright forms and a brief synopsis of Sophia Stewart’s work…from the links you sent me…thanks……… i have to wait until the book is released for me to conduct a critical analysis and form a conclusion based on the researched….If somehow “i’ll be back” appears in the script, then that would lead to some skepticism of course…..one thing i can say is based on their movies prior to matrix and afterwards, i see very little events….can u honestly say that matrix 2&3 were as good as the first? i just recently caught “Goodwill Hunting” which i hadn’t seen since it was in the theatre. I wanted to see if it was as good as when i intially saw it. You know what, there is no way Ben Afleck and Matt Damon wrote that script, it’s just no f***ing way. Time will always reveal the truth.Have either of them written anything remotely close to “Goodwill Hunting” ? If anyone is aware something i’m not please enlighten me. They probably came up with the concept but i don’t think they develope the screen play. Being, i reside in NYC, I know a lot of writers and read a lot of their work, you can see attributes that one developes over time. i spoke to more than a few (screen writers) after viewing it for a second time..One Commented on the Ghost writer that develop the script (Goodwill Hunting). They said that it’s pretty well known in the movie industry that they didn’t develop the script, and that’s my point, if most of the media knows this why is that not reported? They report on everything else pertaining to thier lives, why not the truth? Biased opinions largely based on second hand experiences. Most of us have rarely had any first hand experience with anything period. The best I have found is that the book was never published. I expect that Amazon’s “this title is not currently available” is their way of saying that, due to the requests for it, we sought it out but could not find it available from any publisher. Mr. Walks, you’re writing style is very tough to follow. You run a lot of thoughts together and jump completely off topic. Not an attack, just a hope that future posts are a little easier to read. I have a question for you, in your words above, you state that you are black, but then at the very end, you say “Sometimes I feared for my life, but hey it’s hip hop yo !!!!!!!!!”

As to the topic at hand, I have a hard time believing this woman as there is absolutely no proof to support her claims any where out there on the web. I have spent the better part of the day searching for the actual ideas that were burgled out from under her and can’t find any except for the “I’ll be back” line which she claims was lifted from her ‘They’ll be back’ line. Very slim proof indeed. Any website claiming to have information that proves her story is just reprinting the exact same false article or rehashing her bizarre and vague statements.

“The Terminator” was based on two Harlan Ellison-written “The Outer Limits” episodes, “Soldier” and “Demon With a Glass Hand” (James Cameron admitted this). Harlan Ellison sued James Cameron (Ellison is quite the litigious old curmudgeon), won a settlement, and is acknowledged at the end of “The Terminator” before the credit roll.
“The Matrix” was based on (actually lifted from) Grant Morrison’s comic book series, “The Invisibles”. The Wachowskis read it and are known comic book aficionados. Check out http://everything2.com/title/The+Invisibles+vs.+The+Matrix

@Lex: best response to this topic yet. Having read Ellison’s work, as well as Morrison’s, I agree completely.
@William Dorsey: You seem just as fanatically against Mrs. Stewart as the people that support her, and you too have little “proof” to support your opinions. The only credible thing you said was that people should read her manuscript/book before making a decision.
@dk: Though I agree with your comments about the jumbled way Mr.Walks writes, he made some good points. However, consider yourself blessed if you haven’t been to a hip-hop event and feared for your life. Over the years I’ve been to several events where I noticed people walking in “strapped” and left me feeling a bit fearful for both myself and my date. Especially if something “jumped off” during or at the end of said event. Don’t misunderstand that this as a strictly hip-hop related concept, as I’ve also witnessed the same at rock venues as well (particularly with people who don’t understand being in a mosh pit).
Ultimately, I’ll hold my opinion about Mrs. Stewart legitimacy until AFTER I’ve read her manuscript/book. Anyone having not done that is just blurting out what they feel about the situation. I feel that currently, there are no facts to definitively support either side.

@ Choujin: The reason they are called opinions is because they are not empirical. If you need to see passionate disagreement with unestablished reality as being against the subject of a resurrected incorrect piece of netlore, that is your problem, not mine.
Instead of your bald assertion that my opinions are without proof, why not spell out precisely what points you find to be unsupported?
As I wrote elsewhere, when I first heard it seven years ago, I wanted it to be true and went as far as I could to find actual support for that position. What I reported is what I found. Whatever “fanaticism” you see is, if you will hear the thoughts presented, is in response to the lack of reason and ignoring of contradictory facts by so many African Americans. Failure to cogently recognize reality will not lead us to effective reversal of the conditions we face; when we connive in our own oppression by insisting that what we wish is actual reality, we are not functioning in the real world.
You can define it as you wish, obviously; but the only reason I responded here or at the other site is because of the gross absence of reason in most of the comments and the danger that such displays alert me to vis-a-vis the future of black folk taking actual control over our own situation. Sophia Stewart ain’t got nothing to do with that. But your focus seems to indicate that the veracity of her ongoing claims is the only thing you see as significant in the whole issue.

Gale Anne Hurd is fraud and The Wachowski Brother’s never made a movie that wasn’t someone else’s work - and the Tee-Vee immersed public watches but cannot see. This is much more than just Stewart against the Wachowski’s Cameron & Hurd in that Hollywood is home to SERIAL-THEFT of creativity subsidized by the studio’s. Cameron, Hurd and The Wachowski’s are nothing but “Entertainment Hitmen” - The Blackwater of Hollywood.
In the Stewart case, Fox had her work in 81, said that they liked it, yet gave her the WGA run around as have been done to many others. Meanwhile, John Does from Fox and New World Productions wasted no time conveying the work and developing elements from Stewart’s protected literary work along with Ellison’s to make ‘Terminator’.
This isn’t frivolous. Cameron & Hurd have actually admitted to their felonious dealings by putting Ellison’s name at the end of Terminator but at the same time omitting Ellison’s contribution from their copyright submission. THAT’S FRAUD ON THE COPYRIGHT OFFICE!!! This is why the Hollywood Hitmen ended up removing Ellison’s from the end of the film which probably was a breach of the agreement made with Mr. Ellison in the first place.
For the record, James Cameron, who was an untested director at the time, had just got Run-off a B-Movie by the Italians for “poor shot selection” on Piranha II - and I’m supposed to believe he wrote & directed Terminator all by himself without anyone else’s help?
Bullshit!!!! Cameron worked for Roger Corman (an Old school sci-fi film-maker) during that time, and its highly plausible Corman provided the assistance or at least provided the direction since Cameron’s poor shot selection couldn’t have Made T1 all by himself.
Same thing goes for the Wachowski sisters. How the hell does a couple of twinkle-toes go from “bound” to “Matrix” overnight? Be for real. The matrix was epic.
George Lucas made star wars and that was it folks. Lucas didn’t make his career re-mixing other people’s work like “Vendetta” or “Speed Racer”. There is a conspiracy afoot in Hollywood and its the studio’s that empower people like Cameron, Hurd and the Wachowski’s and that’s what the pin head public just doesn’t want to admit…THE DEVIL WE ALL LIVE WITH.
This is why Stewart has so much support because she’s one of the few that will stand up to Hollywood’s sadistic Entertyranny.

The matter that makes their position indefensible is that Hurd and Cameron planned and implemented a strategy to use false facts to the United States Government, and got away with it. Then the Wachowski’s made the same plan and got caught. When they were caught, the connection between the Third Eye and the Terminator did not stop them. Their conspiracy counted on the fact that the United States would not stop a fraud done on their agents. That is a troubling observation. After that, Cameron gave a false affidavit to the Federal Court. It did not stop them.
And again, Why would these gigantic media conglomerates like Fox and Warner Brothers allow Sophia Stewart to sell her book on Amazon using images of The Matrix and Terminator without demaing Stewart cease and desist? Why won’t Cameron, Hurd, Fox, Warner Brothers and The Wachowski’s counter sue Stewart for making such wild claims for years?
Admittedly so, the most shocking part of this ordeal is to realize neither Cameron, Hurd nor The Wachowski’s have legitimate or otherwise formidable copyright registrations to stand as evidence to the contrary. This is a troubling fact indeed.
Cameron & Hurd has put the entire enterprise into dire straits by; (A) fraudulently omitting the name of Harlan Ellison from their copyright registration of “Terminator 1“ while; (B) simultaneously acknowledging Harlan at the end of that same “Terminator 1” film in addition to; (C) paying Ellison $65,000.00 to $70,000.00 for illegally using his work with an additional $5000.00 to remain silent about the criminal infringement. The aforementioned are premeditated acts by Cameron and Hurd that nullifies their Library of Congress registrations because they reveal the fact that both Cameron and Hurd set forth with fraudulent copyrights to begin with.
Adding insult to injury, the Wachowski’s copywritten “one sheet of paper titled The Matrix” – with some “assignments” to Warner Brothers to stand as the source work for the greatest science fiction movies of our time is the most egregious and bold.
“Perception” has been bought and paid for by Big business, Corporate Media and Wall Street. Everyone has been bailed out including White Collar criminals given a license to steal on Wall Street, Main Street and Hollywood boulevard.
This sheer volume of fraud and criminality gives rise to the false perception that “Evil is Good” instead of Evil being Evil and God as being Good.

I’ve heard her interview, she sounds nothing like a person who could write something interesting. Would have to check her book, thou.
But somethig is clear to me: she has no proof and lies about having won the lawsuit. But what I really wanted to say is this: A person who sees color diferences as something that matters, is a racist. Yes, the africans were enslaved and abused, and what they suffered is unimaginable to me. But if we all want to make it go away forever, we must STOP telling people appart based on their skin color. Not african-american rights, HUMAN rights, period.
That being said, this has probably nothing to do (the matter at hand I mean) with Ms Stewart skin color, but most likely with her lack of evidence.

Hi, I don’t usually respond to these forums but, as an attorney, I had to correct you all on this matter. Ms. Stewart did NOT in fact win her case. Her case was dismissed by summary judgment in favor of the defendants on June 15, 2004. Her RICO allegations were also dismissed and she was ordered to pay attorneys’ fees in the amount of $305,235.62 in 2006. Though it would have been nice to see a little guy (girl) take on and defeat the big guys….these assertions are patently false. Sorry. If you are interested in looking this up for yourself the case number is: 2:03-cv-02873-MMM-VBK in the United States District Court for the Central District of California and styled Sophia Stewart v. So in 2006 she was ordered to pay 305k in attorney fees.
2009- she tried in Utah to file vs her lawyers and both were denied.
Three separate court documents all point to her losing.
This does not mean that her work was not stolen. Just means that she LOST.
The guy that say based on a interview she could not write anything interesting. Don’t assume anything, you can’t tell a book from its cover. I’ve seen guys that look like hippies and talk like a stoner do exceptionally well in Organic Chemistry, Math, physics etc. You make yourself look like an idiot with statements like that.

Izzie I am not sure what your are saying. All I seek is the truth and the truth is being slanted by those who claim she won in court.
As far as discrimination thats a different argument. It could be she LOST in court due to what you say. What I say in no way implies that she did not write the script for the Matrix.
It does not mean that this women did not suffer from injustice. I only mean that she lost in court. People loose in court that should have won.
I have heard this women speak and she actually sounds very honest, she may in fact be a pre cog where she gets her ideas from the future.

Substituting Sarah Connor for “I-Ceus,” Kyle Reese for “strange man with clear, transparent eyes…,” and The Machines for “Morning Star”; you find yourself reading the plot for The Terminator right down to I-Ceus “giving birth to a son who “would one day bring peace to Earth.” I-Ceus even flees to the desert where she is “taken care of.” Notably I-Ceus, rather than the Kyle Reese equivalent, is the virgin on the rather blatantly, ripped-off written page.
In the Character Analysis, ignoring gender and race depicted in the Matrix movie, there are parallels between Sophia Stewart’s (a.k.a. The copyright office will only release The Third Eye and submissions to claimants and those authorized by the claimant. I really want to see it all. Anyone that used the daydream of donning a long black coat, exposing, and delivering righteous vengeance upon bad guys hidden in plain sight to save the world to get through their workday is probably reeling. This is the real “Cypher” Judas mind job–it was robbed. I am not going to lie. I look at anything with WB on it now and wonder. I mean Joel Silver? James Cameron said he had a dream … Jesus. Can you imagine having bought all that swag and staring at it every time you open a closet? I betcha sick s@%t like this is how Rome fell.
As much as I believe in tolerance for people, I hope the judge wipes those thieves’ tails. Such theft has to be stopped. Is this why they sold the terminator franchise? People in this country have tried, vied, and died to enable life, liberty, and the pursuit. For God’s Sake, you can piece together an animated old man playing chess with himself and win an oscar. To all movie producing Americans, eat organic food, adios that hair growth crap that’s poison to your wife (and you) and wrecks a fetus, call your senators to save PBS and NPR, and grow an original, f@c%ing spine!

Looking @ 2sense’s link, it seems that it IS ongoing. If thel ink to the court docs is accurate,then the judge denied the defendant’s request to dismiss the case. I’ve listened to her interviews on youtube and if she made that up, then she’s creative as hell! (Maybe she should write a script about this ordeal.) I think it’s interesting that I haven’t heard much about it in mainstream media. But the lady who has the trillion dollar lawsuit against Sean (P-Diddy) Combs for organizing the Sept 11th attacks has gotten media attention. *sigh

Did you actually read the link? The original lawsuit was dismissed in 2005. The ongoing lawsuit is Stewart’s lawyers suing her. She lost a motion to have it dismissed.

You are correct about the 2005 dismissal but you have the link results backwards. Stewart is listed as the plaintiff against her lawyer/defendant. Whereas, HE lost HIS motion to dismiss in 2009.
